Guardianship of the father and grand father upon the judicious female virgin

وهو المشهور بين المتأخّرين، استقلالها بالعقد دونهما مطلقاً. ونقل عن الشيخ في التبيان، والمرتضى ، والشيخ المفيد في أحكام النساء، وابن الجنيد وسلاّر، وابن إدريس، وهو مذهب المحقّق والعلاّمة

And it is prevalent among the latter scholars that she has independence/freedom from both of them unconditionally in the matter of 'aqd (temporary or permanent marriage). And this ruling has been quoted from Shaikh Tusi's Tibyan fi Tafsir al Qur'an, Sharif al Murtada, Shaikh Mufid's Ahkam al Nisa, Ibn Junaid and Salaar al Daylami. This ruling has been adopted by both Muhaqqiq Hilli and Allama Hilli.

الثالث: للبالغة الرشيدة، أن تمتع نفسها، وليس لوليها اعتراض، بكرا كانت أو ثيبا، على الأشهر

The third point: It is permitted for the mature and judicious woman to do mut'ah herself, and her guardian is not to object, whether she is virgin or non virgin/previously married, as per the prevailing ruling.

لا يشترط إذن الولي في متعة البالغ الرشيدة 

Guardian's permission is not required for mutah of the mature and judicious female.

الثالث: للبالغ الرشيدة أن تمتع نفسها، وليس لوليها اعتراض
بكرا كانت أو ثيبا، على الأشهر

The third point: It is permitted for the mature and judicious woman to do mut'ah herself, and her guardian is not to object, whether she is virgin or non virgin/previously married, as per the prevailing ruling.

And it is permissible for the mature female to get married herself without a guardian.

ولا ولاية على البالغ الرشيد الحر إجماعا ، ولا على البالغة الرشيدة الحرة وإن كانت بكرا على الأصح في المنقطع والدائم

And there is no guardianship upon the free, mature and judicious male as per consensus, neither upon the free, mature and judicious female even if she is a virgin; as per the correct view with regards to the temporary and permanent marriage.

Case of the mature and judicious female virgin regarding marriage

أما البكر البالغة الرشيدة فأمرها بيدها ولو كان أبوها حيا قيل: لها
الانفراد بالعقد دائما كان أو منقطعا

 As for the mature and judicious female virgin, so her affair/issue is in her own hand even if her father is alive. And it has been said (by scholars): "She has complete authority on her marriage, whether it is permanent or temporary marriage."

Abu Abdullah (as)said: "No problem with marrying the virgin if she is satisfied, without permission of her father."

محمد بن أحمد بن يحيى عن العباس بن معروف عن سعدان بن مسلم عن رجل عن أبي عبد الله ع قال: لا بأس بتزويج البكر إذا رضيت من غير إذن أبويها

Muhammad b. Ahmad b. Yahya from al Abbas b. Ma'roof from Su'dan b. Muslim from a man from abi Abdullah (as) who said: "No problem with marrying the virgin when if is satisfied, without permission of her father." 

وبهذا الإسناد عن أبي سعيد قال: سئل أبو عبد الله ع عن التمتع من الأبكار اللواتي بين الأبوين فقال: لا بأس ولا أقول كما يقول هؤلاء الأقشاب

And by this isnad (chains of narration) from abi Sa'eed who said: He asked abu Abdullah (as) about the mut'ah with the virgins still amidst their parents, so Imam (as) said: "No problem, and I do not say as what these scoundrels say." 

وسائل الشيعة للحر العاملي (1104 هـ) الجزء21 صفحة32 باب 11 حكم التمتع بالبكر بغير إذن أبيها

Wasail al Shia by Shaikh Hurr al Amili (ra), Volume 21, Page 32, Section 11 on the ruling for mutah with the virgin without her father's permission.

محمد بن علي بن الحسين بإسناده عن إسحاق بن عمار عن أبي عبد الله (ع) قال: قلت له: رجل تزوج بجارية عاتق على أن لا يقتضها ثم أذنت له بعد ذلك قال: إذا أذنت له فلا بأس

Muhammad b. Yahya b. al Hussain by his isnad (chains of narration) from Ishaq b. Ammar from abi Abdullah (as), he (narrator) said: I said to him (as): "A man married with a young girl upon the responsibility/condition that he does not penetrate her (virginity), then she gave permission to him after that." Imam (as) said: "If she gave permission to him then no problem."

وعنه عن العباس بن معروف عن سعدان بن مسلم عن رجل عن أبي عبد الله (ع) قال: لا بأس بتزويج البكر إذا رضيت من غير إذن أبويها

And from him from al Abbas b. Ma'roof from Su'dan b. Muslim from a man from abi Abdullah (as) who said: "No problem with marrying the virgin if she is satisfied, without permission of her father."  

محمد بن الحسن بإسناده عن محمد بن أحمد بن يحيى عن موسى بن عمر بن يزيد عن محمد بن سنان عن أبي سعيد قال: سئل أبو عبد الله (ع) عن التمتع من الأبكار اللواتي بين الأبوين؟ فقال: لا بأس ولا أقول كما يقول هؤلاء الأقشاب

Muhammad b. al Hasan by his isnad (chains of narration) from Muhammad b. Ahmad b. Yahya from Musa b. Umar b. Yazid from Muhammad b. Sinan from abi Sa'eed who said: He asked abu Abdullah (as) about the mut'ah with the virgins still amidst their parents, so Imam (as) said: "No problem, and I do not say as what these scoundrels say."

عدم ولاية الاب والجد على البكر الرشيدة

Lack of guardianship of the father and the grandfather upon the judicious female virgin.

روي عن الباقر ( عليه السلام ) انه قال : إذا كانت المرأة مالكة امرها تبيع وتشتري ، وتعتق وتشهد ، وتعطى مالها ما شاءت : فان امرها جائز تتزوج ان شاءت بغير اذم وليها وان لم تكن كذلك فلا يجوز تزويجها الا بأمر وليها

It is narrated from al Baqir (as) that he said: “When the woman is owner of her affairs of buying and selling, and freeing/manumitting and witness, and is given of her wealth what she wants: Then indeed, in her case it is permissible that she marry without permission of her guardian, however, if it is not like that then it is not permissible to marry her except with her guardian's permission.”

 سعدان بن مسلم عن الامام الصادق ( عليه السلام ) : لا بأس بتزويج البكر إذا رضيت بغير اذن وليها

Su'dan b. Muslim from abi Abdullah (as) who said: "No problem with marrying the virgin if she is satisfied, without permission of her guardian." 

السابعة : ما يدل على جواز تزويج البكر متعة بغير اذن ابيها ، كخبر ابي سعيد قال سئل أبو عبد الله ( عليه السلام ) عن التمتع من الابكار اللواتي بين الابوين ، فقال عليه السلام  : لا بأس ، ولا اقول كما يقول هؤلاء الاقشاب

 The seventh (point is): What proves upon permissiblity of mut'ah marriage with the virgin without permission of her father, is the tradition by abi Sa'eed who said: He asked abu Abdullah (as) about the mut'ah with the virgins still amidst their parents, so Imam (as) said: "No problem, and I do not say as what these scoundrels say
