Akhbaris and penalty for tatbir

Overview: As a follow-up to the earlier post regarding the Akhbari view of tatbir, this post highlights the fatwa about the required penalty for tatbir. While the previous post had mentioned the penalty for inflicting cuts/scratches on others (including with their consent), this post mentions the explicit fatwa about the required penalty for doing tatbir specifically on one's self. Similar to the previous post, this post does not cover the views of earlier Akhbari scholars as tatbir did not exist in their time so they did not speak about it. Interestingly, while many Usuli scholars have also discouraged or prohibited tatbir, to varying degrees, however - as far as I know - none have imposed a penalty for it.

Note: Since tatbir is a modern phenomenon, to investigate the Akhbari view of tatbir, one needs to examine the views of latter and contemporary Akhbaris. For this purpose, this post covers the view of the contemporary well known traditional Akhbari, Al-Asfoor family in Bahrain (Shaikh Yusuf al Bahrani was their most famous scholar). This post does not cover the views of modern Indian Akhbaris*.

أشاد قاضي‮ ‬محكمة الاستئناف العليا الشرعية الجعفرية الشيخ محسن العصفور بالبيانات التي‮ ‬أصدرتها المآتم والحسينيات في‮ ‬المحرق والدراز ودمستان ضد ممارسة التطبير في‮ ‬عاشوراء وإعلانها عدم تحمل مسؤولية تصرفات المطبرين خلال مواكب العزاء‮.‬
ودعا العصفور الى منع بقية المطبرين في‮ ‬بقية المناطق من هذه الممارسة التي‮ ‬وصفها إنها طارئة على البحرين وعلى الممارسات العزائية عند الشيعة‮.‬
وأكد العصفور خلال لقاء مع‮ »‬الأيام‮« ‬حرمة ادماء الرأس والجسم،‮ ‬ووجوب الكفارة على المطبرين بصيام شهرين متتابعين او اطعام ستين مسكيناً  عن ارتكاب هذا الفعل،‮ ‬ووجوب دفع دية الشجاج على من‮ ‬يقوم بإدماء الآخرين وشج رؤوسهم‮.‬
واضاف أن فقهاء البحرين الأقدمين ومنهم الشيخ‮ ‬يوسف والشيخ حسين والشيخ عبدالله الستري‮ ‬وبقية فقهاء الشيعة في‮ ‬النجف وقم ولبنان‮ ‬يحرمون إدماء البدن ووجوب الكفارة بدون مسوغ‮ ‬شرعي

Judge of Ja'fari Shariah Supreme Court of Appeals, Shaikh Muhsin al Asfoor, praised the statements released by Hussainias and mourning centres in Muharraq, Diraz and Damistan in opposition to the practise of tatbir on Ashura, and their declaration of non-liability for actions of those doing tatbir during azadari processions. Al-Asfoor also called for forbidding rest of the tatbir practitioners in rest of the regions from this practise, which he described as being a state of emergency on Bahrain and Shi'ite azadari rituals.

During meeting with "Al-Ayyam", Al-Asfoor stressed on the prohibition of blood letting from the head and body, and the obligation of kaffarah on the ones doing tatbir, to fast for two consecutive months or feed sixty needy people due to carrying out this act; and the obligation of paying injury compensation on the one who does blood-letting of others and slashes their heads. He added that the earlier jurists in Bahrain - including Shaikh Yusuf al Bahrani, Shaikh Hussain [Al al Asfoor] and Shaikh Abdullah al Satri - and rest of the jurists in Najaf, Qum and Lebanon prohibited blood-letting and ordained kaffarah [for it] if done without religious justification.

*Robert Gleave, in his book "Scripturalist Islam_ The History and Doctrines of the Akhbari Shi'i School" (page 300) provides the following information about contemporary Indian Akhbaris:
 There remains to this day a vibrant Akhbari community in Hydarabad*. Whether these modern Indian Akhbaris should be seen as a continuation of the school of the early Akhbari Husayn b. Shihab al-Din al-Karaki, or connected with Mirza Muhammad's influence or as an entirely different branch of the school, requires further research.

Akhbaris and tatbir

Synopsis: This post briefly covers the view of tatbir among akhbari scholars, as explained by Shaikh Muhsin Al Asfoor (Akhbari scholar from Bahrain, belonging to the family of Shaikh Yousuf al Bahrani, and a serving member of the Supreme Council of Islamic Affairs in Bahrain), in response to a question posed by the Al Watan News team, on his website. Unfortunately this post does not cover the view of earlier akhbari scholars such as Shaikh Hurr al Amili, Mulla Baqir Majlisi, Syed Hashim al Bahrani etc, as tatbir was not there in their times hence they did not speak about it.

- هناك حكمين للتطبير أحدهما يحلله والآخر يحرمه، فإلى اي حكم الشرعي تميل، ولماذا؟

المندوب اليه هو اظهار العزاء ومظاهرالحزن على ما حل على أهل البيت من مصائب من نياحة وتفجع ولطم الصدوراداءاً لحق منزلتهم من رسول الله صلى الله عليه وآله وامتثالاً لواجب مودتهم كما في قوله تعالى : ( قل لا أسألكم عليه أجراً الا المودة في القربي ) أما ما يصل الى حد ادماء الجسد في الصدر او الظهر بالضرب بالزنجيل أو التطبير في الرأس فالذي دلت عليه الأدلة الفقهية وصرح بمضمونها سائر الفقهاء على امتداد القرون الماضية هو حرمة هذا الفعل وقد افردوا في احكام الجنائز وسنن التشييع ومراسيم العزاء على المتوفى فصلاً يتناول احكام اظهار الحزن وحدوده

What is recommended is expressing grief upon the sufferings of the ahlulbayt, due to their [close] position to the Prophet (pbuh) and the obligation to have love for them as Allah (swt) says 'Say: I do not ask you for compensation for this, except for love in kinship', by reciting eulogies, lamenting and beating the chest. As for blood-letting on the chest or back by striking them with sharp chains, or hitting the head with knives; then what is seen in Islamic jurisprudential evidences and the explicit view of the scholars going back up to the past centuries, is that this is haram. The scholars, while writing about the rulings of funerals and mourning rituals, have written dedicated sections on the rulings for expressing grief and its boundaries.

والنص صراحة على حرمة نتف الشعر وخدش الجلد وجز الشعر وتشويه الخلقة واظهار السخط ولو على اعز الأعزة من الأبناء والأباء والأزواج إلا أنه لم يستثن أحد من الفقهاء منه ما كان في إحياء العزاء على مصائب أهل البيت عليهم السلام فيفهم منه عموم الحكم.

وقد روى خالد بن سدير قال : " سألت ابا عبد الله يعني الامام الصادق ( عليه السلام ) عن رجل شق ثوبه على ابيه أو على امه أو على اخيه أو على قريب له ؟ قال لا بأس بشق الجيوب فقد شق موسى بن عمران على اخيه هارون ( عليهما السلام ) ولا يشق الوالد على والده ولا زوج علىامرأته وتشق المرأة على زوجها ، وإذا شق الزوج على امرأته أو والد على والده فكفارته حنث يمين ولا صلاة لهما حتى يكفرا أو يتوبا من ذلك ، وإذا خدشت المرأة وجهها أو جزت شعرها أو نتفته ففي جز الشعر عتق رقبة أو صيام شهرين متتابعين أو اطعام ستين مسكينا وفى الخدش إذا دميت وفى النتف كفارة حنث يمين ، ولا شئ في اللطم على الخدود سوى الاستغفار والتوبة ، ولقد شققن الجيوب ولطمن الخدود الفاطميات على الحسين بن علي ( عليهما السلام ) وعلى مثله تلطم الخدود وتشق الجيوب "

وما يقال بأن السيدة العقيلة زينب كانت قد ضربت رأسها بمقدم المحمل فسال الدم من راسها كلام مردود بما ثبت تاريخياً من ان الامام الحسين عليه السلام كان قد وصاها بوصايا ليلة العاشر من المحرم واخبرها بما سيجري عليه وعلى اهل بيته واصحابه يوم العاشر وما ينبغي عليها ان تظهره من صمود وصبر وجلد فلم تر مثكولة اربط جأشاً وامضى عزيمة واثبت فؤاداً منها يوم العاشر وما بعده وقد سجل التاريخ مواقفها العظيمة وصمودها المنقطع النظير وهذا الثابت التاريخي الذي هو دراية لا يعارض برواية .

The explicit Islamic law based on the Quran and ahadith is that it is haram to pluck the hair [from the head], severely scratching the skin, shaving the hair [of the beard], distorting the creation and expressing exasperation, even while mourning the loss of one's children, parents or spouse; and none of the scholars have declared an exception to this for the mourning of the ahlulbayt, therefore it is understood that this ruling is general.

Khalid b. Sadir has reported: I asked Imam al Sadiq (as) about a man who tears his clothe while mourning his father, mother, brother, or some other close relative? Imam (as) replied: "It is ok to tear the upper-front of the shirt, Musa (as) did it for his brother Harun (as). But it should not be done by the father for his child or by the husband for his wife, the wife may do so for her husband though. If the husband does so for the wife or the father for the child, then their fine is the same as for breaking a vow and their prayers would not be accepted till they pay the fine or repent. If a woman [while mourning] scratches her face, or plucks or shaves her hair, then for shaving the hair the fine is to either release a slave, or fast consecutively for two months, or feed sixty needy people. As for the scratching that leads to bleeding, or for plucking the hair, the fine is the same as for breaking a vow. There is no fine for slapping one's cheeks, it suffices to repent for that. The women from the family of Fatima (as) had torn their shirts' upper fronts and slapped their cheeks at the martyrdom of Hussain (as), and for his (as) like it is ok to slap the cheeks and tear the shirt's upper front."

As for what is said regarding Syeda Zaynab, that she struck her head on the carriage and blood flowed from her head, this is false as it is a historical fact that Imam Hussain (as) had bequeathed her on the night of tenth Muharram, informing her what is going to befall upon him (as) and his (as) family and companions on the day of tenth Muharram, and the patience and steadfastness she is expected to show. [Accordingly] she did not appear tired and defeated; and stayed steadfast throughout tenth Muharram and afterwards. History has recorded her great patience and steadfastness and this is an established historical fact, which cannot be contested by a solitary report.

وما يقال من ان الفقهاء قد افتوا قديماً وحديثاً باستحباب التطبير فلم نر له ذكر ولا أثر قبل ثمانين سنة على ابعد التقادير وما يقال انه من باب تعظيم شعائر الله فليس له وجه يعتد به
وأما انه من مظاهر المودة لأهل البيت فليس بثابت
وأما الاستناد الى قوله عليه السلام : (رحم الله من أحياً أمرنا ) فالمراد يتعلم علوم ائمة اهل البيت ويعلمها الناس كما دل عليه بقية الخبر
وأما قول الإمام الرضا(عليه السلام)( إن يوم الحسين أقرح جفوننا) وما ورد عن الحجة المهدي صاحب الأمر سلام الله عليه في زيارة الناحية المقدسة (لأبكين عليك بدل الدموع دماً... حتى أموت بلوعة المصاب وغصة الاكتياب) فهي من الأساليب البلاغية المجازية للاشعار بعظم الحزن والمصاب الجلل ولا يؤخذ بظاهره كما هو معروف متسالم عليه .

As for what is said that the scholars of the past and present have issued fatawa declaring tatbir to be mustahab, so we have seen no sign or trace of this before any earlier than the past eighty years at best. As for what is said that it is for honouring the signs of Allah (swt), so there is no basis for this. As for it being among the expressions of love for ahlulbayt, so this is not proven. As for the saying of Imam (as): "May Allah (swt) bless the one who revives our legacy", so it is for spreading the knowledge of ahlulbayt and teaching it to the people, as seen by the rest of the report. As for the saying of Imam al Reda (as): "On the day [of martyrdom] of Hussain (as) our eyelids are blistered" and Imam al Mahdi (as): "I will cry upon you with blood instead of tears.....till I die in suffering and swallowing the severe grief", so these are metaphorical expressions of poetic eloquence symbolising the tremendous grief and suffering, and are not meant to be taken literally as is well known and unanimously accepted.

What is your opinion regarding substituting tatbir with blood donation?

نحن ندعو الى كل عمل مشروع جائز وسائغ فضلاً عن كونه راجحاً فيه نفع عام وفائدة لمجتمعاتناوالتبرع بالدم من الأمور الانسانية العظيمة التي يمكن استثمارها في ايام محرم الحرام وقد ساهمت مساهمات كبرى وفاعلة لا سابق لها خلال السنوات الماضية في تأمين احتياجات مستشفيات البحرين من حاجته من الدم وانقذت الآلاف من المرضى من المواطنين والمقيمين من جميع الجنسيات والديانات بل امتدت حتى الى خارج البحرين حيث ارسلت شحنات ضخمة الى بعض الدول الاسلامية المنكوبة في ازماتها التي حلت بها .
وهي مما لا شك فيه انها حركة مباركة ومن ابرز مصاديق قوله تعالى : (ومن احياها فكأنما احيا الناس جميعا)

We encourage all good Islamic acts that are recommended, which are beneficial to our society. Blood donation is a great humanitarian act, which should be continued in Muharram. I have greatly contributed, in an unprecedented manner, in the past years to fulfill the need of hospitals in Bahrain for blood. Thousands of patients, citizens and expats of all genders and religions have been saved, and this has even spread to outside of Bahrain as I have sent large shipments to disaster struck Islamic countries when possible. It is no doubt a blessed move and a prime example of the saying of Allah: "whoever saves a life, it is as if he saved all of humanity".

- من أين نشات فكرة التطبير؟
From where did tatbir originate?

التطبير ليس من العادات العزائية القديمة عند الشيعة وليس لها أي جذور اصيلة وانما نشأ في العقود الثمانية الأخيرة على ابعد التقادير وسمعت ان اول ظهوره كان على يد الهنود الشيعة ثم انتقل منهم الى عوام الشيعة في العراق ايام عاشوراء حيث سيروا بعض المواكب في مدينة كربلاء يوم العاشر ثم تابعهم عوام العراق بعد ان استحسنوه وانتشر بينهم وعنهم اخذ الزوار الايرانيون والخليجيون واللبنانيون وكان موكب التطبير في البحرين مقصوراً على الجالية الأحسائية ثم سرت موجته قبل ثلاثين سنة الى مأتم مدن وبن رجب والقصاب واخيرا ماتم الزينبية في المنامة العاصمة
وقد اشتهر العلامة الشيخ باقر آل عصفور رحمه الله حتى آخر حياته بمعارضة هذه الظاهرة وظاهرة الضرب بالزنجيل ومواكب الموسيقى العزائية والتصريح بحرمتها وانه لا علاقة لها بمودة أهل البيت ومحبتهم واظهار الحزن عليهم وكانت تلك المواكب المتمردة تمر على بيته عناداً له وتمكث فترة طويلة لايذائه بهتافاتها واصوات الموسيقى التي تعزفها.
وتمكن رحمه الله من القضاء على مواكب الموسيقى العزائية الا ان الضرب بالزنجير والتطبير ازدادت مواكبهما.
وقد رأيت كراسا صغيرا لبعض فقهاء العراق وايران يحثون على فعله في سابقة لا سابقة لها في فقه الشيعة الامامية والاحتجاج فيه بتأويلات غريبة وتسطيرات بعيدة عن المباني الفقهية والقواعد الشرعية المعروفة والمتسالم عليها.
وقد سمعت احد فقهاء قم يقول انه افتى كما افتى غيره خوفاً من سطوة العوام وتهديداتهم حيث بلغت الجرأة بالعوام الى تهديد ووعيد كل من يخالفهم بالعدول عن مرجعيته وتقليده اذا لم يسقطوه اجتماعياً ويتهموه بمعاداة اهل البيت عليهم السلام.

Tatbir is not among the ancient mourning practises of the Shias, and it does not have any original roots [within the Shia]. It only started in the last eight decades at best. I have heard that it was started by Indian Shias, from them it was picked up by the Shia public in Iraq during the period of Ashura as some [Indian] azadari caravans travelled to Karbala on Ashura and the Iraqi public followed them [in tatbir] after they were impressed by it. From the Iraqis it was picked up by the Iranian, Gulf and Lebanese visitors. Tatbir in Bahrain used to be limited to the Ahsai community, then some of them travelled to the Hussainias of Madan, Bin Rajab and Qasab, and lastly to Zainabia in Manama. It is well known that Shaikh Baqir Al Asfoor (ra) till his last days used to oppose tatbir, striking with chains and music in azadari, and explicity declared it all to be haram and that these have no connection with love of ahlulbayt and expressing grief for them. These azadari groups used to always pass in front of his house due to their enmity with him. He spent a long time enduring their harassment from loud musical noises. He was eventually able to put a stop to music, but the tatbir and chain striking increased.

I have seen a small group of scholars in Iraq and Iran encourage tatbir which is unprecedented in Imami fiqh. The use strange interpretations, and methodologies that are completely out of line with the basis of Islamic jurisprudence, and well known and unanimously accepted Islamic principles. I once heard a scholar from Qum say that he issues fatwa [encouraging tatbir] just like the others, fearing the power and intimidation of the public, as the boldness of the public has reached the degree that they threaten and intimidate anyone who opposes them, by stripping his marjaiyyah and taqlid if not going as far as to socially boycotting him and accusing him of being an enemy of the ahlulbayt.

وأما المصرحون بحرمة التطبير فهم كثيرون منهم السيد أبو الحسن الأصفهاني أحد ابرز مراجع النجف الأشرف في زمانه فقد أصدر فتوى تحرم التطبير في العام 1926م هذا نصها: «إن استعمال السيوف والسلاسل الحديدية والأبواق وما يجري اليوم في مواكب العزاء بيوم عاشوراء باسم الحزن على الحسين إنما هو محرم وغير شرعي».

As for those who explicitly declared tatbir to be haram, so they are many. Among them is Ayatullah Abul Hasan al Isfahani, one of the major marja of Najaf in his time. He issued a fatwa in 1926, declaring tatbir to be haram, the fatwa is as follows: "Using swords, metal chains, horns/trumpets and other such items that are used these days in azadari camps on Ashura in the name of mourning Imam Hussain (as), is haram and un-Islamic."

وكذا السيد مهدي القزويني في البصرة، حيث أصدر فتوى تحرم التطبير
Ayatullah Mahdi al Qazwini in Basra issued a fatwa declaring tatbir to be haram.

والشيخ محمد الخالصي في بغداد، حيث دعا في بداية الخمسينات إلى نبذ الخرافات والبدع كالتطبير وضرب الزناجير وإعادة الإسلام إلى نهجه الصحيح.
Ayatullah Muhammad al Khalisi in Baghdad, during the 1950s called for eliminating nonsense and innovations such as striking the head and body with knives and chains, and reverting Islam to its correct form.

كما نقل عن السيد محسن الحكيم قوله: «القامات غصة في حلوقنا».
It has been reported from Ayatullah Muhsin al Hakim that "The practise of hitting the head with knives is akin to an unwanted lump in our throats that we cannot swallow."

ونقل عن الشهيد محمد باقر الصدر قوله: «هذا أمر لا يجوز» ويعني به التطبير بالسيوف والقامات.
It is reported from Ayatullah Baqir as Sadr that he said: "It is not allowed", referring to striking the head with swords and knives.

كما انتقدها أيضا الشيخ محمد جواد مغنية. وأنتقد المغالات فيها، ومما قال: «وقد تطرف بعض العجم فأبدعوا فيها بدعا يمقتها الله والناس، من ضرب أنفسهم بالمدي وإسالة الدماء على أثوابهم...».
Ayatullah Muhammad Jawad al Mughnia had also criticised this practise and those who are fanatics about it, he said: "Some non Arabs went to extreme and started a bid'ah which is detested by Allah and His prophet, of beating themselves with sharp instrument and making blood flow onto their clothes."

وقد سمعت ان السيد حسين البروجردي طاب ثراه احد ابرز مراجع التقليد في قم قام قبل محرم في احد السنوات بدعوة جمع من رؤساء المواكب العزائية ووجه اليهم سؤالاً من هو مرجعكم فقالوا جميعاً انت ياسيدنا فقال : اذا كنتم تعترفون وتقرون بأني مرجعكم فأنا اقول لكم بأن التطبير والضرب بالزنجير وادخال الآلات الموسيقية في المواكب العزائية حرام لا يجوز وعليكم طاعتي والتزام أمري
فرد عليه احدهم نحن نقلدك ياسيد طيلة السنة الا في عشرة ايام محرم
وخرجوا من عنده دون جدوى .

I have heard that Ayatullah Burujerdi, one of the major marja of Qum, once preached to a group of leaders of the azadari camps and asked them who is your marja? They all replied that you are. So he said to them: "As you all acknowledge that I am your marja, then I say to you that tatbir, striking oneself with chains, and entering musical instruments in azadari camps is haram and not allowed, and it is obligatory for you to obey me and follow my order." So one of them replied to him: "We follow you year round, but not in the first 10 days of Muharram", and left him immediately.

وقد اشتهر عن السيد محسن الأمين مرجع الشيعة في سوريا ولبنان في زمانه القول بتحريمها في عدة من مؤلفاته وكتبه
It is well known that Ayatullah Syed Muhsin al Amin al Amili, marja f Shias in Syria and Lebanon in his time, had declared tatbir to be haram in many of his books and writings.

- ما هي الآثار المرتبة على التطبير؟
What are the rulings on tatbir?

والمطبر يصدق عليه عدة عناوين شرعية 
1 ـ حرمة الادماء من دون فرق بين ان يكون القصد منه التشبه بما حل على أهل البيت عليهم السلام من مصائب وقتل وتشريد
أو قصد به اظهار التفجع والتوجع على المصاب الذي حل بهم وفي كلا الحالين لا يجوز لعدم الاذن به شرعاً به من قبل أئمة اهل البيت انفسهم لأن شق الجلد والادماء لا يجوز شرعاً الا لغرض صحيح كالعلاج حيث لا يمكن الا بالادماء كالفصادة والحجامة أو اجراء عملية جراحية  ونحوها 
2 ـ حرمة التصرف بالنفس لا لسبب سائغ وفي مثل هذا المورد ينبغي على الحاكم الشرعي منعه من القيام بذلك لأن السفيه يحجر عليه وهذا من مصاديقه 
3 ـ انه يشمله مقولة لايطاع الله تعالى به من حيث يعصى ولايتقرب الى مودة أهل البيت عليهم السلام بما نهوا ونأو بشيعتهم عنه
4 ـ انه يستلزم تنجيس الطرقات والماتم التي عادة ما تكون دوراً للعبادة والذكر في غير اوقات مجالس العزاء واحياء ماثر خاتم المرسلين وعترته الطاهرين صلوات الله وسلاه عليهم اجمعين في الوقت الذي يحول دون استخدامها للعبادات واداء الصلوات المسنونة كليالي الاحياء في ليالي القدر في شهر رمضان وامثالها في غيره  
5 ـ  من يقوم بشق رؤوس الآخرين يلزمه حكم دفع دية الشجاج ولا تبرأ ذمته بصفح المطبر نفسه .

The following rules apply on the one who practises tatbir:
1- It is haram to blood-let, without any difference between the intention being to emulate the sufferings of ahlulbayt, or to express grief for their suffering, it is haram in both cases due to it not being Islamically allowed by the Imams (as) as scratching the skin and blood-letting are not allowed except for the right reasons such as medical treatment requiring blood-letting such as in the case of cupping or surgery etc.
2- It is haram to cause self harm, and the Islamic ruler has the authority to stop him in the case of tatbir.
3- Tatbir exemplifies the saying "Allah is not obeyed through means of disobedience, and one cannot gain proximity to the love of ahlulbayt by means of things that they forbid their shias from."
4- It causes paths and hussainias to become najis, and hussainias are generally used for worship when not in use for azadari, such as for prayers of laylatul qadr.
5- One who strikes the heads of others with knives, is obligated to pay a fine for causing injury to the head, and approval from the one receiving the injury does not absolve him.

Prostrating on carpet, allowed?

Synopsis: The popular Shia view is that the prostration in prayer is only valid if the forehead is placed on bare earth, or on something that grows from the earth, as long as it is not edible or wearable (source). This post briefly examines if it is permissible to prostrate on other items (such as carpets etc) as well. Nevertheless, this post is only meant to serve an academic purpose, and readers are advised to refer to their own trusted scholars (marja, mufti etc) for their individual practices.

Items on which prostration is valid, and the ones on which it is invalid:
(From the book 'Man la yahdaruhul faqih'): Hisham b. al Hakam asked Imam Ja'far al Sadiq (as): 'Please inform me of the items on which it is permissible to prostrate, and the ones on which it is impermissible?' Imam al Sadiq (as) replied: 'Prostration is only permissible on the earth, or that which grows from the earth, except which is an edible or wearable.' So Hisham asked further: 'May I be your ransom, but why is that?' Imam (as) replied: 'Prostration is submission to Allah, so it should not be performed on edibles and wearables, as materialistic people [almost] worship edibles and wearables. As the prostrator is engaged in the worship of Allah, he should not place his forehead on those items of worship of materialistic people on which they take pride. Prostration on the earth is best, as it is the ultimate form of humbleness and submission to Allah.' 
I (Ayatullah Asif Muhsini) say: At best this proves [prostration on other than the earth, or what grows from it apart from the edibles and wearables] it to be just makrooh (disliked).

Prostration is only permissible on earth or that which grows from it, apart from the edibles and wearables such as on a ring, shoe or sock etc. It is allowed though on items which have transformed from being edibles or wearables, such as on the ashes of an edible or wearable, or that which is made from a wearable and cannot be reverted back to its wearable form such as a carpet made from wool or cotton as it is not possible to take apart its threads and transform it back to a wearable form. Among the conditions of impermissibility of prostration is the item being actually a wearable item, same as with the condition of impermissibility on edibles, except if it is argued [for the sake of it] that even the derivatives of edibles and wearables are counted among them. Anyhow, there is unconditionally no issue with prostrating [on such derivatives] apart from the actual edibles and wearables.

Attractive beards, allowed?

"It is important to point out in this regard: Keeping a beard is not always allowed, and in line with the spirit of Islam. Rather, it is contingent upon being not in emulation of the enemies of Islam - among the deviants or non-Muslims- be it the emulation of a person, group, society or organisation. So if for example a person is emulating [in beard style] the French; or Karl Marx, Sartre or Castro; then that is haram in Islam without any questions. Just as shaving the beard can be considered emulating the enemies of Islam, then so can keeping the beard in some cases, and we know that any emulation of the enemies of Islam is haram in Islamic law.

Therefore, it is obligatory for the mukallaf to avoid styling his beard in a fashion which encroaches upon the haram, and to keep the beard or enlengthen some of it in a way that this encroachment is avoided; so that he does not commit haram in the act of trying to follow Islam.

In fact, compared to what we described in terms of avoiding haram, just shaving the beard is much better than these deviant beard styles consisting of bad intentions and corruption; considering that shaving the beard is permissible in itself, while keeping these sorts of beards is haram without any question."

Salat al Wahsha (Namaz e wahshat) and its analysis

*Shaikh al Obaidan is a Saudi scholar, who studied bahth al kharij (advanced hawza studies) under Ayatullah Wahid Khorassani and Ayatullah Jawad Tabrizi for fiqh and usool, Ayatullah Kamal al Haidery for philosophy and Ayatullah Muslim al Dawri for rijal.

وهي المعروفة بصلاة الهدية، أو صلاة الوحشة، وقد جرت عادة الكثير من الفقهاء ذكر هذه الصلاة ضمن الصلوات المستحبة، ولا بأس بالإشارة إليها بصورة موجزة.
'Salat laylah al dafan' (prayer of the burial night) is also commonly known as 'salat al hadiyah' (the prayer gift [for the deceased]) and 'salat al wahshah' (prayer for [easing] loneliness [of the deceased in his grave]). It is common among many of the scholars to mention this prayer, along with other mustahab (recommended) prayers. Here is a brief analysis of it.
لا يخفى أنه ليس لهذه الصلاة ذكر في شيء من كتب قدماء الأعلام، فلم يتعرض لها المفيد، ولا المرتضى، ولا الشيخ في شيء من كتبهم، حتى أن الشيخ(ره) لم يذكرها في كتابه المصباح والذي قد أعده لمثل هكذا أعمال من الصلوات المستحبة والزيارات والدعوات.
It is not a secret that this prayer has found no mention anywhere in the books of the classical scholars. Neither Shaikh Mufid (413 AH), Syed al Murtada (436 AH) or Shaikh Tusi (460 AH) mention it anywhere in their books. Shaikh Tusi did not even mention it in his book 'Misbahul Mutahajjid', which contains many similar mustahab prayers, ziarat and supplications.
كما أنها لم ترد في شيء من المصادر الحديثية الأصلية المعتمدة، فلم يذكرها الكليني(ره)، ولم ترد في شيء من كتب الصدوق(ره)، كما لم يتعرض لها الشيخ(ره) في تهذيبه.
It does not appear anywhere among the classical primary books of ahadith either. Neither did Shaikh Kulaini (329 AH) mention it, nor is it found anywhere in the books of Shaikh Saduq (310 AH). Shaikh Tusi did not mention it in his 'tahdhibul ahkam' either.
والظاهر أن أول ظهور لها كان في عصر السيد ابن طاووس، فقد ذكرها في كتابه فلاح السائل، حذيفة بن اليمان عن النبي(ص).
It seems it first appeared in the period of Syed ibn Tawus (664 AH), who mentioned it in his book 'Falah al Saeyl', quoting from Hudhaifa b. al Yaman who reported it from the Prophet (pbuh).*
ثم نقلها ممن بعده الكفعمي صاحب المصباح(ره)، فقد نقلها من كتاب الموجز لابن فهد الحلي، وهو قد نقلها عن النبي(ص). والرواية التي ذكرها في المصباح تغاير الرواية التي ذكرها السيد ابن طاووس، كما سيتضح عند نقل الروايتين.
After Ibn Tawus, it was mentioned by Shaikh al Kaf'ami (905 AH), author of 'Misbah'. He quoted it from Ibn Fahad al Hilli's book 'Al Mojiz', who in turn reported it from the Prophet (pbuh).* The narration that al Kaf'ami mentioned in 'al misbah' differs from the narration reported by Ibn Tawus, as would become clear shortly when the narrations are presented.
وقد أوجب خلو المصادر الفقهية والحديثية من الإشارة لهذه الصلاة، توقف بعض الأعلام في مشروعيتها، بل جزمه بكونها من الموضوعات، قال صاحب الحدائق(ره): لكن شرعية هذه الصلاة على هذا الوجه المخصوص من الكيفية والزمان وكمية العدد المشهور فيها، ونحو ذلك لما لم يثبت من طريق أهل البيت(ع)، فهو لا يخلو من احتمال البدعية، وعدم المشروعية، فإن العبادة وإن كانت من حيث كونها عبادة راجحة ومستحبة، لكن لو انضم إلى ذلك أمر آخر من التخصيص بكيفية مخصوصة أو زمان مخصوص أو نحو ذلك من المشخصات مع عدم ثبوت ذلك شرعاً فإنه يكون تشريعاً، ألا ترى أن الأخبار قد استفاضت بتحريم صلاة الضحى، مع كونها صلاة، والصلاة خير موضوع، إلا أنه لما انضم إلى ذلك تخصيص استحبابها بهذا الوقت المخصوص، والعدد المخصوص ونحو ذلك من الخصوصيات مع عدم ثبوت ذلك شرعاً حصلت الحرمة وصارت بدعة، والحكم كذلك في هذه الصلاة مع عدم ثبوت مشروعيتها على هذا الوجه المذكور عن أهل البيت(ع)، واحتمال كون تلك الأخبار من طرق العامة كما لا يخفى.
The lack of its presence in the books of fiqh and ahadith caused some of the scholars to not consider it permissible, and in fact feel certain that it is a fabrication. Shaikh Yusuf al Bahrani wrote in 'Hadaiq al Nadirah' (Vol 10, Page 547): "This prayer being prescribed in a particular fashion, for particular times and containing an ordained number of units as is commonly known; as well as other particulars of it none of which are established to be from ahlulbayt (as), makes it a likely bid'ah (innovation in religion) and impermissible. While acts of worship, due to virtue of being acts of worship, are encouraged and recommended, but if specific conditions are added to them; such as a specific way or time of offering, or anything similar to that which is not established to be ordained in Islamic law, this is then considered to be creating Islamic law by oneself. Have you not seen, numerous ahadith deem 'salat al duha' to be haram, despite it being a prayer and prayer being a good act, but since conditions have been added to it with regards to it being mustahab at a specific time, consisting of a certain number of units as well as other similar conditions which are not established to be ordained in Islamic law, thus salat al duha is deemed haram and a bid'ah. Therefore the same ruling applies to salat al wahshah, due to it not being established that the ahlulbayt(as) ordered praying it in this particular manner (i.e. as it is prayed these days), and it is highly likely that these ahadith [in shia books which describe how to pray salat al wahshah] originate from non-shia sources."

*Translator's note: Apart from salatul wahshah not being mentioned in books prior to the 7th century AH period of Syed Ibn Tawus, Ibn Tawus and Kafa'mi report it in mursal fashion as well, which makes the narrations of salatul wahshah even weaker.

Ramadan moon sighting: The possible influence of Al-Biruni on the classical Baghdadi scholars

A summary of Ayatullah Sistani's lecture, delivered on 6 October 1996, quoted by Ayatullah Yaqubi in his book 'Mathematics for the Islamic jurist' pages 200 - 202 (original Arabic pages posted at the bottom of he post):

'The issue of “Ramadan always being a 30 days month” was a disputed issue in the mid-fourth century AH. Shaikh Mufid wrote a treatise*, which was quoted by Syed Ibn Tawus in ‘Iqbalul Aamal’ (vol 1 pages 33 - 35), to refute those who claim that Ramadan can be of 29 days as well and that the start and end of Ramadan are determined based upon moon sighting instead. The main proponent of this view was Shaikh Ibn Dawud al Qummi*, which Shaikh Mufid considered to be a modern heresy. Shaikh Mufid wrote: “What proves his [Ibn Dawud al Qummi’s] lie is, that in the current year 363 AH, eventhough the hadith narrators and scholars now are less in number as compared to the past, but nonetheless they are all unanimous on the view that Ramadan is always 30 days. Among those who hold this view are Shaikh Abi Muhammad al Hussaini, Shaikh Ibn Qulaweh, Shaikh Saduq and his brother Hussain b. Ali b. Babuweh al Qummi, and Shaikh Haroon b. Musa al Tala’kbari.” It seems that Shaikh Mufid, who was in his thirties at that time and this was his first treatise on this topic, had been influenced by his teacher Ibn Qulaweh, who had also written a treatise to refute Ibn Dawud, who was a great scholar.

Shaikh Saduq also mentioned this view (that Ramadan is always 30 days) in his book “al Khisal” (page 531) and reported nine ahadith that support this view, and commented after that: ‘The view of the elite and analytical Shias is that Ramadan is never less than 30 days, and the ahadith which state this are in line with Quran and against the aama (sunnis). Therefore, the feeble minded amongst the Shias who instead support the narrations which occurred due to taqiyya and which state that Ramadan can be less than 30 days and like all other months, it can sometimes be of 29 days and sometimes 30 days; are [inadvertently] doing taqiyya like the aama [whose practices are in line with the Shia narrations stated out of taqiyya]’.

Syed Ibn Tawus mentioned that Shaikh Karajaki also had this view [that Ramadan is always 30 days]. Shaikh Mufid then later rescinded his view in his book ‘Masabih al Noor’ (‘Lanterns of light’), and embraced Ibn Dawad’s position [that Ramadan can infact be 29 or 30 days as per moonsighting]; in his book ‘risalah al adadiyah’(page 15) which is published by the title ‘Jawab ahlul Mosul’, he was asked about the view that Ramadan is always 30 days, and he responded that I have provided a sufficient reply to this in my book ‘Masabih al Noor’. Also, Sharif al Murtada and Shaikh Tusi, both of whom were students of Shaikh Mufid, wrote treatises in refutation of the view that Ramadan is always 30 days, and so eventually this view ceased to exist. Al Biruni, who was their contemporary and one of the greatest Muslim scholar of Mathematics and Astronomy, and among those after whom the latter scholars termed his era – the fourth century AH – the ‘Era of appearance of sciences’, mentioned in his book ‘Al Athar al baqiyah’ that it is strange that it has been reported from the Imams (as) that they believe in Ramadan always being 30 days, even though this is contrary to Astronomy. Al Biruni was based in Baghdad [for some period] and was their contemporary, and I believe that it is possible that he therefore had an influence on Shia scholars to rescind their view that Ramadan is always 30 days, such that this view eventually ceased to exist.'

*Translator's note: Ayatullah Koei has cast doubts about the attribution of such a treatise to Shaikh Mufid, and has even considered it to be a possible lie. However, as he has not presented any substantial evidence, it seems appropriate to trust Syed Ibn Tawus's attribution of the treatise to Shaikh Mufid, considering that Syed Ibn Tawus precedes Ayatullah Koei by almost 726 years.

*Translator's note: While it is possible that Al Biruni's scientific view acted as the catalyst towards the change in stance of the Baghdadi scholars, but it is interesting to note, that the person who initially held this view of Ramadan being possibly 29 or 30 days, was the traditional master Qummi muhadith and knowledgeable rijali, Ibn Dawud al Qummi. Ibn al Ghadairi considered him to be the most knowledgeable in hadith and fiqh, and he had also authored a book on rijal. It is also interesting to note, that Shaikh al Mufid, in his 'Jawabat ahlul Mosul', does not provide any scientific arguments (let alone mention al Biruni) but instead focuses a lot on ahadith and rijal, and it is not unlikely that those arguments are the same that Ibn Dawud al Qummi would have advanced in the first place. Overall, it seems likely that al Biruni's view stimulated Shaikh Mufid to rethink his earlier position during his younger days of relative immaturity, thereafter he embraced Ibn Dawud al Qummi's position, and did not make a reference to al Biruni as scientific/secular arguments would have been considered irrelevant among the clergy back then, and may even have been damaging to his reputation, and giving credit to al Biruni would have also meant giving publicity to his other ideas as well some of which may not have been in line with his orthodox views; and most importantly, unlike Western universities of today, giving accurate references back then (arguably even now) was not important among clerics.

Crawling in shrines and kissing them, a bidah?

'There is a strange bid'ah that people have lately invented, in the method of ziyarah. As you know, all the Imams (as) used to visit the pure grave of the Prophet (pbuh) and the pure graves of the ahlulbayt (as) in Medina, Iraq and Iran; but have you ever heard that any of the Imams (as) or the scholars used to crawl upon his torso from the entrance of the shrines to the grave spot during their ziyarah? So if this act was mustahab or good in itself, then surely the great scholars would have performed it, however, they did not perform such acts. In fact, it has been mentioned that Ayatullah Burujerdi, who was a very pious scholar and leading mujtahid, and a man of pioneering ideas; forbade even the kissing of the doorstep of the shrines of any of the Imams (as).'

Reciting Nikah formula in non-Arabic, allowed?

These days, marriage ceremonies are conducted by 'Shaikhs' (also called 'Maulana' in the Indo-Pak region) who recite the Nikah formula in Arabic. This article seeks to determine, whether this tradition is a religious necessity, or (with regards to religion) does it only serve to make the act of marriage even harder than it already is? This article also applies to Mut'ah marriages, especially as mut'ah marriages are not as common and culturally acceptable as permanent marriages, therefore making it harder to arrange a 'Shaikh' for it.

"Mustamassakul Urwatil Wuthqah" by Ayatullah Mohsin al Hakim, Volume 14 Page 368

قال في التذكرة: " فلو تلفظ بأحد اللفظين بالفارسية أو غيرها من اللغات غير العربية مع تمكنه ومعرفته بالعربية لم ينعقد عند علمائنا. وهو قول الشافعي وأحمد ". ونحوه عن المبسوط. وعلل في التذكرة: بأن غير العربي بالنسبة إليه كالكناية، فلا يعتبر به. وفي الجواهر: بأنه مقتضى الأصل، الذي لا يعارضه الاطلاق، لانصرافه إلى المتعارف، وفي كشف اللثام: بأنه مقتضى الأصل، والاحتياط في الفروج. والمناقشة في ذلك كله ظاهرة، إذ كونه كالكناية ممنوع، كعدم الصحة في الكناية إذا كانت الدلالة ظاهرة. والأصل والاحتياط لا مجال لهما مع الاطلاق. والانصراف إلى العربية - لأنه المتعارف - بدوي، لا يعول عليه في رفع اليد عن الاطلاق.
مع أن كون المتعارف مطلقا العربية ممنوع، بل المتعارف عند أهل كل لغة ما هو بلغتهم، فلو بني على تقييد المطلق بالمتعارف كان اللازم اعتبار كل لغة عند أهلها، فلا يصح بالعربية لغير العربي - فالبناء على جواز غير العربي - كما عن ابن حمزة - غير بعيد، بل هو المتعين


Allama Hilli wrote in his 'Tadhkiratul Fuqaha': "If one of the words (in the nikah formula) is pronounced in Farsi or some other non-Arabic language, while having the capability and knowledge of reciting it in Arabic, then the Nikah is not established as per our scholars. This is also the view of Imam al Shaf'i and Imam Ahmad ibn al Hanbal." Shaikh Tusi wrote likewise in his 'Mabsoot'.

The reason provided by Allama Hilli in 'Tadhkiratul Fuqaha" is that; 'compared to reciting the formula in Arabic, reciting it in non-Arabic is only hinting towards the intention of nikah, therefore it is not relied on'. Shaikh Muhammad Hasan al Najafi reasoned in "Jawahirul Kalam": 'It is a necessity to the way Nikah was originally recited (in the shariah of Prophet Muhammad), nor is it hindered by applicability, due to its sticking to the known customs.' And Allama Fadil al Hindi reasoned in his "Kashful Litham": "It is a necessity to the way Nikah was originally recited, and a necessary precaution in the sensitive issue of Nikah.".

The fallacy of these claims is self-evident. Regarding the first claim that non-Arabic recitation serves only as a hint towards intention of nikah; this is invalid as non-Arabic recitation can definitely be explicit enough. As for Arabic recitation being a necessity to the way Nikah was originally recited, and this being a matter of precaution; then this contradicts applicability (in current times). 

As for sticking to Arabic due to it being the tradition, this is completely primitive reasoning; which cannot be relied upon to ignore the issue of practicality. After all, the absolute tradition is by no means Arabic recitation, because the tradition of each community is in their own language. So if the absolute is to be qualified by custom/tradition, it is obligatory to consider each community's own tradition and rely upon their own language, therefore it would in fact be incorrect to recite in Arabic for non-Arabs.

Therefore, allowing recitation in non-Arabic, as was decreed by Shaikh Ibn Hamzah al Tusi (in "al Waseela"), is not far off. In fact that is the most correct opinion.

The fifth issue: Is it a condition that Nikah be conducted in Arabic, with regards to the Nikah formula recitation being in Arabic? Or is it allowed in other languages as well?

Answer: There are two views regarding this. The first is the former (i.e. that Nikah should be in Arabic), and that is the famous view. In fact Allama Hilli and Shaikh Tusi have claimed an ijma' on it, that Nikah should be in Arabic when it is possible to do so, in their "Tadhkiratul Fuqaha" and "Mabsoot" respectively. Shaikh Muhammad Hasan al Najafi in his "Jawahirul Kalam" has also supported this view, reasoning that this is sticking to the tradition, which is Arabic.

But Ayatullah Mohsin al Hakeem has challenged this view in his "Mustamassak", by rejecting the need to stick to tradition for the sake of it, as well as dismissing the claim that the absolute tradition is in Arabic; because the tradition of each community is their in own language so if the requirement is to stick to tradition then it is obligatory to consider each community's own tradition and rely upon their own language. Thereby, reciting in Arabic would not be correct for non-Arabs.

Some others have favoured recitation in Arabic due to precaution, by Ayatullah Muhsin al Hakim has rejected this as well.

The second view, proposed by Shaikh Ibn Hamza al Tusi as well as a number of modern scholars, is that it is allowed to recite in non-Arabic. The reason for this is quite obvious. After all, the contract of Nikah is like any other agreement (for example, trade agreements do not need to be conducted in Arabic, even though they are regulated by Islamic law) and has been ordained in a general manner despite the people being so much in need of it and Allah has not revealed any specific order regarding the obligation of Nikah formula in Arabic; while encouraging people towards Nikah aggressively.

Non Shias: From "Najis Kuffar" to "Muslim brothers"

 This post is divided into four parts, to ascertain four fundamental issues:

The first Shia Imami scholar in history to deviate from the orthodox stance, to accept non Shias as Muslims and consider them 'tahir' (non najis)

(Chapter title) Misconception of Muhaqqiq Hilli is the root of this tragic problem:

"Had Muhaqqiq Hilli (602-676 AH) not decreed a fatwa declaring non Shias to be tahir/non najis Muslims in dunya and their kufr being applicable to akhirah (hereafter) only, there would have never been even a sign and trace of such an opinion among Shia scholars. He was among the latter scholars (the classical shias scholars considered non Shias to be najis kuffar in dunya and akhirah) and was the very first one ever  to declare non Shias to be non najis in dunya, and his opinion influenced his successors whereby they would just blindly parrot his reasoning for his fatwa instead of conducting self investigation, as if they were his muqallids........

After Muhaqqiq Hilli, the first ones to follow him in declaring non Shias as tahir Muslims in dunya and their kufr being limited to akhirah only, were the akhbari scholars such as Baqir Majlisi (1110 AH) in Biharul Anwar and Shaikh Abdullah b. Saleh al Bahrani (1130 AH)............The well known latter usooli scholars then simply followed them blindly in this regard."

Now that it has been established that classical scholars used to consider non shias najis kuffar, it should be noted that one who declared the non shias to be tahir (non najis), in fact perhaps the first one ever to deviate from the orthodox stance (in non shias being najis kuffar) to declare them to be Muslims and laws of Muslims being applicable upon them in dunya (while them being kuffar in akhirah) was Muhaqqiq Hilli in his book "al Mu'atbar".

 Islamic ruling upon the status of non shias 

دليل القائل بالنجاسة: أنهم كفرة ونصاب، وكل أولئك أنجاس

Reasons adopted by proponents of their (non shias') najasah (ritual impurity), their being kuffar (disbelievers) and nasibis, and all of them being najis (ritually impure).

أما الأول: فلانكارهم ما علم من الدين ضرورة، ولتواتر الأخبار معنى به، ولذا صرح جماعة بكفرهم، كابن نوبخت مسندا له إلى جمهور أصحابنا، والشيخ في التهذيب، والسيد، والحلي، والفاضل في بعض كتبه، وهو الظاهر من المفيد والقاضي

As for the first (reason), so it is due to their rejection of what is known to be among the fundamentals of religion, and due to tawatur of the ahadith implying such. And thus a group of scholars like Ibn Nawbakht (predecessor of Shaikh Sadooq) as well as the majority of the classical Imami scholars, Shaikh Tusi (385 - 460 AH) in Tahdhibul Ahkam, Sharif al Murtada (355 - 436 AH), Ibn Idris al Hilli (543 - 598 AH), and Allama Hilli (648 - 726 AH) in some of his books (in Muntahul Matlab) declared them to be kuffar. And this ruling is also apparent from Shaikh Mufid (336 - 413 AH) and Qadi ibn al Barraj (401 - 481 AH).

Islamic ruling upon the status of non shias

المشهور بين متأخري الأصحاب هو الحكم باسلام المخالفين وطهارتهم، وخصوا الكفر والنجاسة بالناصب كما أشرنا إليه في صدر الفصل وهو عندهم من أظهر عداوة أهل البيت (عليهم السلام) والمشهور في كلام أصحابنا المتقدمين هو الحكم بكفرهم ونصبهم ونجاستهم وهو المؤيد بالروايات الإمامية، قال الشيخ ابن نوبخت (قدس سره) وهو من متقدمي أصحابنا في كتابه فص الياقوت: دافعوا النص كفرة عند جمهور أصحابنا ومن أصحابنا من يفسقهم.. الخ. وقال العلامة في شرحه أما دافعوا النص على أمير المؤمنين (عليه السلام) بالإمامة فقد ذهب أكثر أصحابنا إلى تكفيرهم لأن النص معلوم بالتواتر من دين محمد (صلى الله عليه وآله) فيكون ضروريا أي معلوما من دينه ضرورة فجاحده يكون كافرا كمن يجحد وجوب الصلاة وصوم شهر رمضان. واختار ذلك في المنتهى فقال في كتاب الزكاة في بيان اشتراط وصف المستحق بالايمان ما صورته: لأن الإمامة من أركان الدين وأصوله وقد علم ثبوتها من النبي (صلى الله عليه وآله) ضرورة والجاحد لها لا يكون مصدقا للرسول في جميع ما جاء به فيكون كافرا. انتهى. وقال المفيد في المقنعة: ولا يجوز لأحد من أهل الايمان أن يغسل مخالفا للحق في الولاية ولا يصلي عليه
ونحوه قال ابن البراج. وقال الشيخ في التهذيب بعد نقل عبارة المقنعة: الوجه فيه أن المخالف لأهل الحق كافر فيجب أن يكون حكمه حكم الكفار إلا ما خرج بالدليل.
وقال ابن إدريس في السرائر بعد أن اختار مذهب المفيد في عدم جواز الصلاة على المخالف ما لفظه: وهو أظهر ويعضده القرآن وهو قوله تعالى: " ولا تصل على أحد منهم مات أبدا.. " (١) يعني الكفار، والمخالف لأهل الحق كافر بلا خلاف بيننا

The popular view among the latter scholars is that the non shias are Muslims and Tahir (ritually pure/clean), and they single out the nasibi as being a kafir (disbeliever) and najis (ritually impure/unclean) as we pointed out at the start of the section. The nasibi according to them is one who expresses enmity towards the ahlulbait.

While what is popular among the classical scholars is that the non shias are kuffar (disbelievers), nasibis and najis. This view is supported by shia ahadith. Shaikh ibn Nawbakht who was one of the classical scholars, said in his book "Fas al Yaqoot": "The ruling of kufr has been advocated by the majority of our companions, while there are some among our companions who consider them sinners........". And Allama Hilli explained this text by saying "As for defending the Prophet (pbuh)'s ruling of Ali (as) being the Imam, so most of our companions have ruled upon the non shias being kuffar (disbelievers) since the hadith designating Ali as the Imam is known to be mutawatir, thereby making it a fundamental aspect of the religion. Therefore, one who rejects it is deemed a kafir like one who rejects the obligation of salat (Islamic prayer) or fasting of Ramadan." And he adopted this view in his book "Muntahul Mutlab" where he wrote in the section on zakat, while explaining the conditions of it being necessary for the receiver to be a believer "Because the Imamate is among the pillars of the religion and its fundamentals, and evidence of its necessity is known from the Prophet (pbuh), its rejector does not affirm collectively what the Prophet (pbuh) came with, therefore he is deemed a kafir...."

And Shaikh Mufid said in his book "al Muqnia": "It is not permissible for anyone among the believers to bathe the dead body of an opponent of the truth of wilayah, or to pray upon him." Qadi ibn al Barraj also said similar to it. And Shaikh Tusi wrote in his book "Tahdhib al Ahkam" after quoting the above mentioned text of "al Muqnia": "The reason for this is that the opponent of the people upon the path of haqq (truth) is a kafir, thereby deserving the ruling of a kafir, except for the one who is exempted due to proof." And Allama ibn Idris al Hilli also adopted the view of Shaikh Mufid regarding the impermissibility of praying the funeral prayer of the non shia, he wrote: "It is apparent and supported by the Qur'an. Allah says (al Qur'an 9:84) "And never offer a prayer on any one of them who dies", which means that they are kuffar. The opponent of the people of truth is a kafir and there is no disagreement among us on this point."

ومذهب المرتضى في ذلك مشهور في كتب الأصحاب إلا أنه لا يحضرني الآن شئ من كلامه في الباب. وقال الفاضل المولى محمد صالح المازندراني في شرح أصول الكافي:
ومن أنكرها يعني الولاية فهو كافر حيث أنكر أعظم ما جاء به الرسول وأصلا من أصوله. وقال الشريف القاضي نور الله في كتاب إحقاق الحق: من المعلوم أن الشهادتين بمجردهما غير كافيتين إلا مع الالتزام بجميع ما جاء به النبي (صلى الله على وآله) من أحوال المعاد والإمامة كما يدل عليه ما اشتهر من قوله (صلى الله عليه وآله) (٢) " من مات ولم يعرف إمام زمانه مات ميتة جاهلية " ولا شك أن المنكر لشئ من ذلك ليس بمؤمن ولا مسلم لأن الغلاة والخوارج وإن كانوا من فرق المسلمين نظرا إلى الاقرار بالشهادتين إلا أنهما من الكافرين نظرا إلى جحودهما ما علم من الدين وليكن منه بل من أعظم أصوله إمامة أمير المؤمنين عليه السلام

And the view of Sharif al Murtada on this issue is well known among the books of our companions, however, at the moment I (Shaikh Yusuf al Bahrani) do not have present with me anything from him on this topic. And Ayatullah Saleh Mazindrani wrote in his commentary of Usul al Kafi: "And whoever denied it, i.e. wilayah, so he is a kafir as he has denied the greatest fundamental principle brought by the Prophet (pbuh)." And Qadi Noorullah Shostri (Aka Shahid Thalith) wrote in his book Ihqaqul Haq: "It is known that the two testimonies alone are not sufficient until they are supplemented collectively with what was brought by the Prophet (pbuh) among the teachings of resurrection and Imamate, as is evidenced by the popular hadith "Whoever died without knowing the Imam of his time, would have died the death of jahilliyah." And there is no doubt that its denier is neither a Momin (believer) nor a Muslim because even though the Ghulat and Khawarij are listed as Islamic sects due to their professing the two testimonies (shahadatain) but they are still kuffar due to their rejection of what is known to be a part of religion, and from it, in fact from the greatest of religious principles is the Imamate ofAmirul momineen (as)."

وممن صرح بهذه المقالة أيضا الفاضل المولى المحقق أبو الحسن الشريف ابن الشيخ محمد طاهر المجاور بالنجف الأشرف حيا وميتا في شرحه على الكفاية حيث قال في جملة كلام في المقام في الاعتراض على صاحب الكتاب حيث إنه من المبالغين في القول باسلام المخالفين: وليت شعري أي فرق بين من كفر بالله تعالى ورسوله ومن كفر بالأئمة (عليهم السلام) مع أن كل ذلك من أصول الدين؟ إلى أن قال: ولعل الشبهة عندهم زعمهم كون المخالف مسلما حقيقة وهو توهم فاسد مخالف للأخبار المتواترة، والحق ما قاله علم الهدى من كونهم كفارا مخلدين في النار، ثم نقل بعض الأخبار في ذلك وقال والأخبار في ذلك أكثر من أن تحصى وليس هنا موضع ذكرها وقد تعدت عن حد التواتر. وعندي أن كفر هؤلاء من أوضح الواضحات في مذهب أهل البيت (عليهم السلام) انتهى

And among those who concurred with this view is Muhaqqiq abu al Hasan al Sharif ibn al Shaikh Muhammad Tahir, who resided by Najaf al Ashraf till death, in his commentary upon "Al Kifayah" where he wrote in a section, objecting upon its author for being a proponent of the non shias being Muslims: "I wonder, is there any difference between disbelieving in Allah and His messenger, and in disbelieving in the Imamate of the Imams even though they are all from the fundamentals of the religion?" He further continued: "And perhaps they are under the impression that the non shia is a Muslim in reality, but it is an invalid delusion which goes against the mutawatir ahadith, and the truth is what has been stated by Sharif al Muratada that they are kuffar who would reside in hell forever." He then quoted some ahadith about that and stated that "they are far too numerous to be enclosed and neither is it the place to mention them, and they have surpassed the limit of tawatur. And according to me the kufr of non shias is among the most explicit issues in the school of ahlulbait."

هذا، والمفهوم من الأخبار المستفيضة هو كفر المخالف الغير المستضعف ونصبه ونجاسته، وممن صرح بالنصب والنجاسة أيضا جمع من أصحابنا المتأخرين: منهم شيخنا الشهيد الثاني في بحث السؤر من الروض حيث قال بعد ذكر المصنف نجاسة سؤر الكافر والناصب ما لفظه: والمراد به من نصب العداوة لأهل البيت (عليهم السلام) أو لأحدهم وأظهر البغضاء لهم صريحا أو لزوما ككراهة ذكرهم ونشر فضائلهم والاعراض عن مناقبهم من حيث إنها مناقبهم والعداوة لمحبيهم بسبب محبتهم، وروى الصدوق ابن بابويه عن عبد الله بن سنان عن الصادق (عليه السلام) (١) قال: " ليس الناصب من نصب لنا أهل البيت لأنك لا تجد أحدا يقول أنا أبغض محمدا وآل محمد ولكن الناصب من نصب لكم وهو يعلم أنكم تتولونا وأنكم من شيعتنا ".. وفي بعض الأخبار (٢) " أن كل من قدم الجبت والطاغوت فهو ناصب " واختاره بعض الأصحاب إذ لا عداوة أعظم من تقديم المنحط عن مراتب الكمال وتفضيل المنخرط في سلك الأغبياء والجهال على من تسنم أوج الجلال حتى شك في أنه الله المتعال. انتهى. ونحوه في شرحه على الرسالة الألفية. وممن صرح بالنصب جماعة من متأخري المتأخرين: منهم السيد نعمة الله الجزائري في كتاب الأنوار النعمانية حيث قال: وأما الناصبي وأحواله وأحكامه فإنما يتم ببيان أمرين: (الأول) في بيان معنى الناصب الذي وردت الروايات أنه نجس وأنه شر من اليهودي والنصراني والمجوسي وأنه كافر باجماع الإمامية، والذي ذهب إليه أكثر الأصحاب (رضوان الله عليهم) أن المراد به من نصب العداوة لآل محمد (صلى الله عليه وآله) وتظاهر ببغضهم كما هو الموجود في الخوارج وبعض ما وراء النهر، ورتبوا الأحكام في باب الطهارة والنجاسة والكفر والايمان وجواز النكاح وعدمه على الناصبي بهذا المعنى، وقد تفطن شيخنا الشهيد الثاني من الاطلاع على غرائب الأخبار فذهب إلى أن الناصبي هو الذي نصب العداوة لشيعة أهل البيت (عليهم السلام) وتظاهر في القدح فيهم كما هو حال أكثر المخالفين لنا في هذه الأعصار في كل الأمصار

This, and the meaning of the extensive ahadith is that the non shia, other than the mustadh'af (the totally ignorant one who is not in any position to find the truth), is a najis kafir and nasibi. And among the latter scholars who advocated that the non shias are najis nasibis, one of them is Shahid al Thani. In his discussion about leftover water from pool/puddle, afterwards he mentioned the najasah of the pig, kafir and the nasibi by saying: "What is meant by the term nasibi is one who harbors enmity towards the ahlulbait or towards one of them, or displays hatred for them whether explicitly or indirectly such as by disliking the mentioning of ahlulbait and the propagation of their merits, or turns away from those of their virtues which are truly their virtues, and has enmity towards their lovers due to their love for ahlulbait. Shaikh Sadooq narrated from Abdullah b. Sinan, from Imam al Sadiq (as) who said: "The nasibi is not the one who has enmity towards us ahlulbait for indeed you will not find anyone say "I hate Muhammad (pbuh) and his family", instead the nasibi is the one who has enmity towards you people while he knows that you people love us and are among our shias." And it has been reported in some ahadith that "Whoever gives precedence to Jibt and Taghoot, then he is a nasibi." And some of our companions adopted the view that there is no greater hostility than to raise the lowly to the rank of perfection while lowering the one of high status following the way of the idiots and the jahils, upon one about whom the height of glory is assumed such that it was doubted about him that he is Allah." And he wrote similar in his commentary of "Risalah al Alfiah".

Among the latter generation of the latter scholars, those who advocated the non shias being nasibis is Allama Ni'matullah al Jazairi. He wrote in his book Anwar al Nu'mania: "And as for the nasibi, his condition and the rulings about him, so indeed it would be explained by two issues: First, the meaning of the term nasibi.There are ahadith about it that he is najis and is worse than the Jew, Christian and Zoroastrian, and he is a kafir as per the consensus of the Imami Shias. And many of our companions hold the view that the meaning of nasibi is the one who has enmity towards the family of Muhammad (pbuh) and is displayed by some of them, as is present in the khawarij and some who go beyond, and have arranged the rulings in the section on taharah (ritual purity), najasah, kufr, eeman (belief) and the permissibility and impermissibility of nikah upon the nasibi according to this definition. And our shaikh, Shahid al Thani discerned from the information in strange ahadith, so he adopted the view that the nasibi is the one who holds enmity towards the Shias of ahlulbait and expresses slanders on them, as is the state of our opponents in this period in all the countries."

What did the succeeding mutakhireen (latter) scholars say about non Shias?

و يطلق على من أخل بشي‏ء من العقائد الإيمانية و إن لم يكن ضروريا لدين‏
الإسلام كالإمامة، و المشهور أنهم في الآخرة بحكم الكفار و هم مخلدون في النار كالمخالفين و سائر فرق الشيعة سوى الإمامية، و قد دلت عليه أخبار كثيرة أوردناها في كتابنا الكبير، لكن قد عرفت أنه يظهر من كثير من الأخبار أنه يمكن نجاة بعض المخالفين من النار كالمستضعفين و المرجون لأمر الله، و قد ذكر العلامة و غيره قولا بعدم خلود المخالفين في النار، و هو في غير المستضعفين و أشباههم في غاية الضعف لأن الإمامة عند الشيعة من أصول الدين، و قد ورد متواترا عن النبي صلى الله عليه و آله و سلم من مات و لم يعرف إمام زمانه مات ميتة جاهلية، و الأخبار في ذلك أكثر من أن تحصى.

And whoever does not believe in something required for eeman (true belief), although not essential for Islam (i.e. to be a mere Muslim) such as Imamah, so it is well known that they are considered kuffar (disbelievers) in the akhirah and would reside in hellfire like the non Shias and all the sub sects of Shiaism other than the Imamis (i.e. Twelver Shias). This has been proven by extensive ahadith which we have recorded in our voluminous book. However, it is known that it is apparent in ahadith that it is possible that some non Shias would be relieved from hellfire, such as the mustada'fs (feeble minded and ignorant people without resources) and those who return (repent) to the command of Allah (swt). Allama Hilli and others mentioned the view of non Shias not residing in hellfire, and it (being hell bound) is for other than the mustada'fs and their likes, because as per shias Imamah is among the fundamentals of religion, and it has been reported in mutawatir ahadith from the Prophet (pbuh) that "Whoever died and did not know the Imam of his age, then he died the death of jahilliyah", and the ahadith on that are too many to be mentioned.

و أما الأحكام الدنيوية أيضا كالطهارة و التناكح و التوارث فالمشهور أنهم في جميع ذلك بحكم المسلمين، و ذهب السيد المرتضى رضي الله عنه و جماعة إلى أنهم في الأمور الدنيوية أيضا بحكم الكفار، و الذي يظهر من بعض الأخبار أنهم واقعا في جميع الأحكام بحكم الكفار لكن الله تعالى لما علم أن للمخالفين دولة و غلبة على الشيعة و لا بد لهم من معاشرتهم رخص لهم في جميع ذلك و أجرى على المخالفين في زمان الهدنة و التقية أحكام المسلمين و في زمن القائم عليه السلام لا فرق بينهم و بين الكفار، و به يمكن الجمع بين الأخبار

 And as for the religious rulings to be applied to them in dunya (i.e. in this world, not the hereafter), such as in issues of taharah (ritual purity), nikah (marriage) and inheritance, so it is popular that they would be treated as Muslims in all those issues, while Sharif al Murtada and a group of scholars adopted the view that they should be treated as kuffar in dunya also. And it does appear from some of the ahadith that they should truly be treated as kuffar in all Islamic affairs, but however, since Allah (swt) knew that the non Shias would rule and prevail over the Shias and therefore the Shias would have no choice but to socialize with them, thus He (swt) made a concession for the Shias on this and established the application of Islamic laws upon non Shias during the period of truce and taqiyya. But when Imam Mahdi (as) appears, there would be no difference between the non Shias and the kuffar. This way it is possible to reconcile between the ahadith (i.e. to reconcile those ahadith which declare non shias to be Muslims and those which declare them kuffar).

 قال الشهيد الثاني (ره) في رسالة حقائق الإيمان: اعلم أن جمعا من علماء الإمامية حكموا بكفر أهل الخلاف و الأكثر علي الحكم بإسلامهم، فإن أرادوا بذلك كونهم كافرين في نفس الأمر لا في الظاهر، فالظاهر أن النزاع لفظي إذ القائلون بإسلامهم يريدون ما ذكرناه من الحكم بصحة جريان أكثر أحكام المسلمين عليهم في الظاهر، لا أنهم مسلمون في‏نفس الأمر، فلذا نقلوا الإجماع على دخولهم في النار، و إن أرادوا بذلك كونهم كافرين باطنا و ظاهرا فهو ممنوع، و لا دليل عليه بل الدليل قائم على إسلامهم ظاهرا كقوله عليه السلام: أمرت أن أقاتل الناس حتى يقولوا لا إله إلا الله

Shahid Thani wrote in his journal "Haqaiqul Eeman" (The realities of faith): "Be aware that a group among the scholars ruled the non Shias to be kuffar, while most of the scholars ruled them to be Muslims. So if they (i.e. the former group) intend by that to declare the non Shias to be kuffar in reality but not in dhahir (i.e. the apparent), then it appears that the difference is merely an issue of differing terminologies, as the proponents of non Shias being Muslims imply what we mentioned regarding the correctness of applying the laws of Muslims upon the non Shias in dhahir although they are not Muslims in reality. Thus they have quoted an ijma' (consensus) upon the non Shias being hell bound, but if by that they mean to say that the non Shias are kuffar in reality as well as in the dhahir then that is invalid. There is no evidence for that, in fact there is  evidence upon the non Shias being Muslims in dhahir as per the hadith of Imam Ali (as): "I have been ordered to fight the people till they say 'la ilaha illallah' (There is no deity but Allah)."

قال عبد الله المامقاني في تنقيح المقال: 1/208 ط. نجف ، باب الفوائد : ( وغاية ما يستفاد من الأخبار جريان حكم الكافر والمشرك في الآخرة على كل من لم يكن اثني عشرياً

Allama Abdullah al Mamqani wrote in Tanqihul Maqal (Major shia rijal book), Volume 1 Page 208 (published in Najaf): ": "The conclusion that is reached from the ahadith is that the ruling of kafir (disbeliever) and mushrik (polytheist) would apply in the hereafter upon anyone who is not a Shia Ithna Ash'ari (i.e. Twelver Shia)."

قال محمد بن حسن النجفي في جواهر الكلام : 6/62 : ( والمخالف لأهل الحق كافر بلا خلاف بيننا ، كالمحكي عن الفاضل محمد صالح في شرح أصول الكافي ، بل والشريف القاضي نور الله في إحقاق الحق ، من الحكم بكفر منكري الولاية ، لأنها أصل من أصول الدين

Muhammad b. Hasan al Najafi wrote in Jawahirul Kalam, Volume 6 Page 62: "And the opponent of the people of truth is a kafir, without any disagreement between us (i.e. the scholars), as has been reported by Fadhil Muhammad Saleh in his exegesis of Usul al Kafi, as well as by Qadi Noorullah Shostri in Ihqaqul Haq wherein he declared the denier of Wilayah a kafir as it is a fundamental principle among the fundamentals of religion."

قال يوسف البحراني في الحدائق الناضرة : 18/53 : ( إنك قد عرفت أن المخالف كافر لاحظ له في الإسلام بوجه من الوجوه ، كما حققنا في كتابنا الشهاب الثاقب

Shaikh Yusuf al Bahrani stated in Hadaiqul Nadhirah, Volume 18 Page 53: "Indeed you know that the non shia has no share in Islam in any way, as we revealed in our book Shahab al Thaqib."

قال المجلسي في بحار الأنوار: 23/390 ط. بيروت : ( إعلم أن إطلاق لفظ الشرك والكفر على من لم يعتقد بإمامة أمير المؤمنين والأئمة من ولده (ع) وفضل عليهم غيرهم ، يدل على أنهم كفار مخلدون في النار

Baqir Majlisi declared in Biharul Anwar, Volume 23 Page 290 (Published in Beirut): "Note that the terms shirk (polytheism) and kufr (disbelief) apply to one who does not believe in the Imamah of Ali (as) or his progeny, and gives precedence to others over them, proving that they are kuffar destined to reside in hell."

قال عبد الله شبر في حق اليقين في معرفة أصول الدين : 2/188 ط. بيروت : ( وأما سائر المخالفين ممن لم ينصب ولم يعاند ولم يتعصب ، فالذي عليه جملة من الإمامية كالسيد المرتضى أنهم كفار في الدنيا والآخرة ، والذي عليه الأشهر أنهم كفار مخلدون في النار   

Abdullah Shabbar wrote in Haqqul Yaqeen, Volume 2 Page 188 (Published in Beirut): "And as for the rest of the non Shias among those who do not have nasb (i.e. are not nasibis), hostility and prejudice, so a number of Shia scholars like Sharif al Murtada declared them to be kuffar in this world as well as in the hereafter, and the prevailing ruling is that they are kuffar destined for hell."

What do the modern scholars, especially the 'pro unity' ones (such as Ayatollah Khomeini, Ayatullah Khoei, Ayatullah Tabatabai etc) say about brotherhood between Shias and non Shias?

  المراد بالمؤمن الشيعة الإمامية الاثني عشرية . وأما الأخبار فما اشتملت على المؤمن فكذلك ، وما اشتملت على الأخ لا تشملهم أيضا لعدم الأخوة بيننا وبينهم بعد وجوب البراءة عنهم وعن مذهبهم وعن أئمتهم ، كما تدل عليه الأخبار واقتضته أصول المذهب...وقال: فإنها في مقام تفسيرها اعتبرت الأخوة فيها ، فغيرنا ليسوا بإخواننا

What is meant by the term 'momin', is Shia Ithna Ash'ari only. As for the ahadith which are applicable on the 'momin', so they are meant to be for the Imami shias only. Therefore, the ahadith which mention 'your brother' (for example ahadith on backbiting being akin to eating the meat of one's brother) do not include the non shias (sunnis etc) for there is no brotherhood at all between us Imami shias and the non Shias. In fact, it is absolutely obligatory to do tabarra from them, their schools of thought and their leading scholars, based upon our ahadith which deem it (absolute tabarra from non shias) to be the core of our religion. So whenever brotherhood is implied in religious interpretations, it must be kept in mind that non shias our by no means our brothers.

It is a matter of basic common sense that there is no brotherhood or support/partnership between us shias and the non Shias.

The attribution of iman (belief) and brotherhood towards non shias is completely invalid. There are explicit and mutawatir ahadith which invalidate this claim, furthermore there are mutawatir ahadith from the Imams (as) mocking and cursing the non shias, as well as calling them worse than Jews and Christians, and filthier than dogs.
