Mutah with prostitute

ولا بأس أن يتمتع الرجل بالفاجرة، إلا أنه يمنعها بعد
العقد من الفجور. وليس على الرجل أن يسألها: هل لها زوج أم
لا، لأن ذلك لا يمكن أن تقوم له به بينة. فإن اتهمها في ذلك،
احتاط في التفتيش عن أمرها. وإن لم يفعل، فليس عليه شئ

And it is not problematic that the man does mutah with a prostitute, but that he forbids her from prostitution after the marriage. And it is not required of the man to ask her if she has a husband or not because it is not possible that an evidence be provided for it. So if she is accused of that (already having a husband) then it is precautionary to do an investigation of her affair, although even if he does not do it there is no blame upon him.

Shaikh Tusi said in al Nihayah: "It is not problematic that the man does mutah with a prostitute, but that he forbids her from prostitution after the marriage."

وما رواه زرارة قال: سأله عمار وأنا عنده عن الرجل يتزوج الفاجرة
متعة؟ قال: لا بأس، وإن كان التزويج الآخر فليحصن بابه (٥

And that is narrated from Zurarah that he said: Ammar asked him (as) while I was with him (as), regarding a man who marries the prostitute in mutah. He (as) said: "No problem, though if it was the other marriage then he is to fortify his door." (Tahdhibul ahkam Volume 7, Page 203, hadith 1090; Wasail al shia, Volume 14, Page 400, section 9 in the section of mutah, hadith 1)

وعن علي بن يقطين قال: قلت لأبي الحسن - عليه السلام -: نساء أهل
المدينة، قال: فواسق، قلت: فأتزوج منهن؟ قال: نعم (٦

And from Ali b. Yaqtin who said: I said to abi al Hasan (as): "The women of Medina." He (as) said: "Lewd (loose/bad charactered)" I said: "So can I marry from them?" He (as) said: "Yes." ولا بأس أن يتمتع الإنسان بالفاجرة، إلا أنه يمنعها بعد العقد عليها من الفجور
ولا يجب على الرجل سؤالها هل لها زوج أم لا؟ لأن ذلك لا يمكن أن
يقوم له به بينة.
والأولى في الديانة سؤالها عن ذلك، إن كانت مصدقة على نفسها، وإن
كانت متهمة في ذلك احتاط في التفتيش عن أمرها، استحبابا لا إيجابا

And it is not problematic that the person does mutah with the prostitute, but that he forbids her from prostitution after the marriage. And it is not obligatory for the man to ask her if she has a husband or not because it is not possible to have evidence for that. And it is best in the faith/religion to ask her about that if she was regarded trustworthy/honest, but if she had been accused then it is precautionary to investigate her affair. This is recommended, not obligatory.

وما رواه في كتاب قرب الاسناد في الصحيح عن علي بن رئاب " قال: سألت أبا عبد الله عليه السلام عن المرأة الفاجرة يتزوجها الرجل المسلم؟ قال: نعم، وما يمنعه؟
ولكن إذا فعل فليحصن بابه مخالفة الولد

And that is narrated in the book Qarb al Isnad by a sahih sanad (authentic/reliable chain of narration) from Ali b. Ra'ib who said: I asked aba Abdullah (as) about the prostitute woman, the Muslim man marries her? He (as) said: "Yes, and what stops him? But when he does it then he should fortify his door for violation of child."

والصحيح المروي في قرب الإسناد: عن المرأة الفاجرة يتزوجها الرجل
المسلم، قال: نعم وما يمنعه، ولكن إذا فعل فليحصن بابه

And it has been narrated by a sahih sanad (authentic/reliable chain of narration) in Qarb al Isnad about the prostitute woman, the Muslim man marries her. He (as) said: "Yes, and what stops him? But when he does it then he should fortify his door."

ومتى أراد الرجل تزويج المتعة فليس عليه التفتيش عنها بل يصدقها في قولها

1091) 16- From him from Su'dan from Ali b. Yaqtin who said: I said to abi al Hasan (as): "The women of Medina." He (as) said: "Lewd (loose/bad charactered)" I said: "So can I marry from them?" He (as) said: "Yes." And when the man intends to do mutah marriage then it is not upon him to investigate about her, rather, he should trust her word.

[17281] 1- Shaikh Mufid has recorded in his Risalah al Mutah (Journal on Mutah): From al Hussain b. Huraiz who said: I asked aba Abdullah (as) about the woman upon whom adultery is committed, can I do mutah with her? He (as) said: "Have you seen that?" I said: "No, but she is accused of it." He (as) said: "Yes, do mutah with her upon that you leave and lock your door."

29 - وعن الحسن بن جرير قال: سألت أبا عبد الله - عليه السلام - في المرأة تزني عليها أيتمتع بها؟ قال: أرأيت ذلك؟ قلت: لا، ولكنها ترمى به قال: نعم يتمتع بها على أنك تغادر وتغلق بابك.

29 – And from al-Hasan b. Jarir who said: I asked aba Abdullah (as) about the woman upon whom adultery is committed, can I do mut`a with her?  He (as) said: "Did you see that?"  I said: No, but she is accused of it."  He (as) said: "Yes, do mut`a with her upon that you leave and lock your door."

Question: A man knows that a woman is a fornicator but does not know if she is known or unknown (regarding her fornication), so is it permissible to do mutah with her?

(ج) لا بأس ما لم يعلم بالوصف (أهي مشهورة أم غير مشهورة)

 Answer: No problem as long as he does not know characteristic (that is, whether she is a known or an unknown fornicator).

  2. @Anonymous: Wa'laikum assalam,

    It doesn't seem possible that the term is implying condom. This is because it's unlikely that condoms were widely being used in that time and place (if they even existed back then), and this is so becuase we have ahadith which say that 'azl (i.e. coitus interruptus) is allowed in muta'. If condoms were widely being used back then then it wouldn't make much sense for the Imams (as) to tell about 'azl.

    So what does it then mean? Taking into account all the texts, I believe "fortifying the door" is telling the man to lock up his door (see hadith below):

    And from al-Hasan b. Jarir who said: I asked aba Abdullah (as) about the woman upon whom adultery is committed, can I do mut`a with her? He (as) said: "Did you see that?" I said: No, but she is accused of it." He (as) said: "Yes, do mut`a with her upon that you leave and lock your door."

    Remember, muta' with prostitute is allowed (although it is makrooh/disliked) to STOP prostitution, not to propagate it:

    "And it is not problematic that the man does mutah with a prostitute, but that he forbids her from prostitution after the marriage."

    So the man is commanded to lock up his door so that the woman can neither go to another man nor invite some other man (locking up women is recommended in general in ahadith, not just in this instance: http://realtashayyu.blogspot.com/2011/02/career-women-vs-hadith.html)

    Also, by taking this precaution people will hopefully not come to know that he's done muta' with prostitute and hence his reputation will not suffer.
