Islamic ruling for children born out of wedlock

 حکم ولد الزنا للشیخ محسن

Ruling for the illegitimate born, by Shaikh Mohsin Aale Asfoor (Akhbari Scholar from Bahrain)

المشهور بين الأصحاب سيما المتأخرين القول بطهارة ولد الزنا و الحكم بإسلامه و دخول الجنة، و عن ابن إدريس القول بكفره و نجاسته، و نقل العلامة في المختلف القول بالكفر عن المرتضى و ابن إدريس، و نقل جملة منهم عن الصدوق ايضا القول بالنجاسة و الكفر، قال في المختلف في باب السؤر: قال الشيخ أبو جعفر بن بابويه لا يجوز الوضوء بسؤر اليهودي و النصراني و ولد الزنا و المشرك و جعل ولد الزنا كالكافر، و هو المنقول عن المرتضى و ابن إدريس

The popular view among the companions, especially the latter scholars, is that the illegitimate born (walad al zina) is ritually pure (tahir), is considered a Muslim and is eligible to gain entry to heaven. While Shaikh Ibn Idris al Hilli had upheld the view of him being a najis (ritually impure/unclean) Kafir (disbeliever), and Allama Hilli quoted in his book Mukhtalif al Shia the views of Sharif al Murtada and Ibn Idris al Hilli which declare him a Kafir. And a group among them (i.e. the scholars) quoted from Shaikh Sadooq (ra) also, the view of him being a najis Kafir. Allama Hilli wrote in Mukhtalif al Shia, under the section of "leftovers": "Shaikh Sadooq (ra) did not allow performing wudu (ablution) with the leftover water of the Jew, Christian, illegitimate born or polytheist, and he characterized the illegitimate born like the Kafir. The same view has also been quoted from Sharif al Murtada and Shaikh Ibn Idris al Hilli."

    In which book, as Saduq said it ?

    The article is very good but you have forgotten to speak about ahadith like :

    -Rasul Allah (SAWAS) : "Ya 'ali la yuhibbuka illa mumin wala yubriduka illa ibnu zina"

    - Rasul Allah (SAWAS) : "Al jannatu muharramatun 'ala awladu zina"

  2. Wa'laikum assalam,

    Shaikh Sadooq said that in al Hidaya (page 68): ولا يجوز الوضوء بسؤر اليهودي، والنصراني، وولد الزنا ، والمشرك، وكل من خالف الإسلام

    Translation: "And it's not permissible to do wudu with leftover (water) of the jew, christian, walad al zina (one born from fornication), polytheist, and anyone who opposes Islam."

    I didn't include ahadith in this post because this article was just meant to briefly show the fiqh position of walad al zina as per classical scholars. Maybe inshallah later I'll update the article to include all relevant ahadith.
