فما هو الثقل الأكبر ؟ كتاب الله ، أم آل محمّد :

استفتاء:
 ورد عن الرسول الأعظم (صلى الله عليه وآله) أنّه قال : « إنّي تارك فيكم الثقلين كتاب الله وعترتي أهل بيتي ، أحدهما أكبر من الآخر » ، فما هو الثقل الأكبر ؟ كتاب الله ، أم آل محمّد ؟

Question: It has been reported that the prophet (pbuh) said: "I am leaving among you two critical items, the book of Allah and my ahlulbayt. One of them is greater than the other." So which is superior, Quran or ahlulbayt?
جواب:
 بإسمه جلت اسمائه  
ممّا لا ريب فيه أنّ أصل حديث الثقلين حديثٌ متواترٌ مقطوعٌ بصدوره عن النبيّ الأعظم (صلى الله عليه وآله) ، إلاّ أنّ هذا لا يلازم القطع بصدور بعض الزيادات الواردة في بعض طرقه ، ومن جملتها الزيادة المُشار إليها في السؤال ، فإنّها من ناحية لم يتكثّر نقلها في جميع طرق حديث الثقلين حتّى يقال بتواترها ،ومن ناحية اُخرى لم تصلنا بطرق معتبرة يمكننا التعويل عليها ، بل كلّ طرقها مخدوشة السند ، مضافاً إلى معارضتها بغيرها ، كالحديث الذي أورده الديلمي في إرشاد القلوب عن رسول الله الأعظم (صلى الله عليه وآله) : « إنّي تارك فيكم الثقلين كتاب الله وعليّ ابن أبي طالب (عليه السلام) ، وعليّ بن أبي طالب أفضل لكم من كتاب الله » ، والذي يظهر من بعض المأثورت أنّ هذا المعنى كان واضحاً عند أجلاّء الصحابة ، إلاّ أنّ أيدي الوضّاعين قد عبثت فيه ، والشاهد على ذلك أنّ ابن عباس لما قيل له : ما تقول في عليّ بن أبي طالب (عليه السلام) ؟ قال : ذكرتَ والله أجلّ الثقلين ، ومن سبق بالشهادتين ، و صلّى القبلتين ، وبايع البيعتين ، إلى آخر الحديث ، فعبّر عن أمير المؤمنين (عليه السلام) بأنّه ( أجلّ الثقلين ) ممّا يعني وضوح كون أهل البيت (عليهم السلام) بنظر الصحابة هم الثقل الأكبر .

Answer: What is certain is that hadith al thaqalain itself is mutawatir, and definitely issued by the prophet (pbuh). But this does not necessitate additional portions of this hadith having being issued by the prophet(pbuh), such as the additional portion mentioned in the question [i.e. 'one of them is greater than the other']. This is so, because on one hand, this additional portion has not been mentioned in too many sources of hadith al thaqalain, which would then enable it to become mutawatir. Secondly, this additional portion has not been reported to us through reliable chains of narration - which may enable us to rely on it - on the contrary; all of its chains of narration are weak, in addition to it being in contradiction with other ahadith. For example, it has been reported by Shaikh al Daylami in Irshadul Quloob from the prophet(pbuh): "I am leaving among you two critical entities, the book of Allah and Ali b. abi Talib; and Ali is better for you than the book of Allah". And what is apparent from some textual sources is that this notion was well known among the foremost companions, except that the hands of the fabricators managed to cover it up. What serves as an evidence for this, [is the recorded incident] that when it was said to Ibn Abbas: "What do you say about Ali?" He replied: "I swear by Allah that the person you mentioned is the foremost of the 2 critical items (thaqalain), among the earliest to accept Islam, prayed towards both qiblas (i.e. towards the inital qibla in the early days of Islam, as well as towards the ka'ba after it was ordained the qibla), pledged allegiance to the prophet(pbuh) twice................(till the end of the hadith)". Therefore, Ibn Abbas's reference to Imam Ali as being the 'foremost of the two critical entities' proves the explicitness of the ahlulbayt being the greater of the two critical entities, within the eyes of the companions.

Third Question: The Prophet said: "I leave behind among you 'al Thaqalayn' (the two weighty/important things), the book of Allah and the ahlulbayt, so that if you hold onto both then you will never be misguided after me.". Which is the 'thaql al akbar' (greater of the two weighty/important things), Qur'an or the ahlulbayt (as)?

اتفقت جميع المصادر الشيعية على عدم وجود لفظ" أحدهما أكبر من الآخر " إلا في مصادر المخالفين جاء فيها عن زيد بن أرقم ، قال : قال رسول اللَّه صلَّى اللَّه عليه وآله وسلَّم : « إنّي مخلَّف فيكم ما إن تمسّكتم به لن تضلَّوا بعدي  أحدهما أعظم من الآخر : كتاب اللَّه حبل ممدود من الأرض إلى السماء ، وعترتي أهل بيتي ، ولن يفترقا حتّى يردا عليّ الحوض ، فانظروا كيف تخلفوني فيهما » .
ورواه الصدوق في كمال الدين ص 234 من طرق العامة وهو التالي: حدثنا محمد بن إبراهيم بن أحمد بن يونس قال : حدثنا العباس بن الفضل
عن أبي رزعة ، عن كثير بن يحيى أبي مالك ، عن أبي عوانة ، عن الأعمش ، عن حبيب
ابن أبي ثابت ، عن عامر بن واثلة ، عن زيد بن أرقم قال : لما رجع رسول الله صلى الله عليه وآله
من حجة الوداع نزل بغدير خم ثم أمر بدوحات فقم ما تحتهن ، ثم قال : كأني قد
دعيت فأجبت إني تركت فيكم الثقلين أحدهما أكبر من الاخر : كتاب الله وعترتي أهل
بيتي فانظروا كيف تخلفوني فيهما فإنهما لن يفترقا حتى يردا علي الحوض...". ورواه في كتاب عيون أخبار الإمام الرضا عليه السلام محذوف السند ويظهر أنه من طرق العامة كعادته الشيخ الصدوق ينقل كثيراً من كتبهم. كما أنه رواه في موضع آخر من كتابه إكمال النعمة من طريق عيسى بن يونس الواقفي عن زكريا بن أبي زائدة ، عن عطية العوفي ، عن أبي سعيد الخدري..وزكريا وعطية من رواة العامة...وبالغض عن كل ذلك لو سلمنا بصحة الأخبار الدالة على أن أحدهما أكبر من الآخر فالخلاف بتعيين أيهما الأكبر هل هو الكتاب أم العترة ؟ والظاهر منه بضميمة القرائن الأخرى هو العترة باعتبارهم هم الأوحدون الذين يترجمون القرآن الكريم على حقيقته الواقعية لما في الكتاب من مجملات ومتشابهات وناسخ ومنسوخ وعام وخاص ومطلق ومقيّد فلا يعرف شيء من ذلك إلا بالرجوع إلى العترة الطاهرة سلام الله عليها وكما قال أمير المؤمنين الإمام الأعظم سلام الله عليه :ط هذا كتاب الله الصمات وأنا كتابه الناطق ولا ينفع صامت من دون ناطق" وقوله عليه السلام :" أنا كلام الله الناطق

  وقد فسر بعضهم الثقل الأصغر بالعترة والأكبر بالكتاب وادعى في ذلك إتفاق الأخبار في هذا المعنى..وهو خلاف الحقيقة غذ لا يوجد بطرقنا الشيعية في مصادرنا..نعم موجود في مصادرنا من طرق المخالفين


Answer: No Shia source contains the words "one of them is greater than the other". This addition is only found in mukhalif (non-Shia) sources. In non-Shia sources it is reported from Zayb . Arqam that the Prophet (pbuh) said: "I leave behind among you that which if you hold onto then you will never be misguided after me. One of them is greater than the other: The book of Allah, the outstretched rope from the Earth to the Heaven; and my ahlulbayt. So be careful of how you treat them after me, for they will not separate from each other until they return to the fountain (of Paradise, on judgement day)."

This hadith is reported by Shaikh Sadooq, in Kamaluddin Page 234, but from aami (non-Shia) sources as follows: Told us Muhammad b. Ibrahim b. ahmad b. Yunus, who said: Told us Al Abbas b. al Fadal, who reported from Abi Zar'a, who reported from Kathir b. Yahya abi Malik, who reported from Abi  Awanah, who reported from al 'Amash, who reported from Habib b. abi Thabit, who reported from Aaamir b. Wathilah, who reported from Zayd b. Arqm that he said: "When the Prophet (pbuh) returned from his last Hajj, he came upon Ghadir khum. He ordered stoppage by the large trees, so camps were setup thereunder. He then said: Please understand that Allah has called for me and I have accepted the call (i.e. my time of death is very close). I leave behind among you the thaqalayn, one of them is greater than the other: The book of Allah, and my ahlulbayt. So be careful of how you treat them after me, for they will not separate from each other until they return to the fountain (of Paradise, on judgement day)."

Shaikh Sadooq also reported this hadith in "Uyun Akhbar ar Reda" without sanad, and it seems that it is also from aami (non-Shia) sources as it was the habit of Shaikh Sadooq to often quote from non-Shia books. He also reported this hadith in another section of his book Kamaluddin, from the following chain: Isa b. Yunus al Waqifi from Zakariya b. abi Zaida, from Atiyah al Ufi, from Abi Saeed al Khudri. Zakariya and Atiya of this chain are aami (non-Shia) narrators.

Regardless of all of this, even if we were to accept these ahadith which indicate that "one of them is greater than the other", there would still remain the question as to which of them is actually greater than the other (as the aforementioned aami ahadith do not pinpoint which is greater of the two), is it the Qur'an or the ahlulbayt? What becomes apparent, by additional evidences (from rest of the ahadith) is that it is the ahlulbayt, as they are the only ones who interpret the Qur'an as per its actual reality with regards to the complexities found therein; in terms of verses which may be brief, ambiguous, abrogating (of other verses), abrogated (by other verses), general, specific, unconditional and conditional, for none of these can be correctly understood without referring to them. As is reported from Imam Ali (as): "The Qur'an is the silent book, whereas I am the speaking (living and talking) book of Allah. The silent book does not provide benefit without being accompanied by the speaking book.". It is also narrated that Imam Ali (as) said: "I am the speaking (living and talking) speech of Allah".

Some people have interpreted the 'thaql al asghar' (the lesser of the two weighty things) to be the ahlulbayt and the 'thaql al akbar' to be the Qur'an, and have claimed that this is due to the consensus of the ahadith towards this meaning. But this is contrary to the reality, since no such hadith is found in our sources via a shia tariq (intermediaries/chain of transmission), they are only found in our sources via mukhalif (non-Shia) turuq (chains of transmission).

Dua Nudba, authentic?

Synopsis: This article examines the authenticity (or lack of) of Dua Nudba, by analysing its sources of origin. However, this article does not cover Dr Ali Shariati's suspicion regarding this dua being of kaysanite origins, as I believe his reasoning is not strong enough. Advanced readers may refer to Ayatullah Kadhim's Tusturi's response to this here.

Question 7: What does Dua Nudba mean to you, your eminence? Is its recitation like any other act of worship, or is it a way of life that the person should live by with the Imam (as)?

Answer 7: It is possible to look at Dua Nudba from many angles, some of which may seem negative initially, but nevertheless are important as per academic standards. So therefore, when we look at it in terms of sanad (chain of narration), we find that multiple experts in the field of Isnad and ahadith have refused to confirm this dua as being authentic, however; they have not forbidden its recitation as long as it is recited just as a dua (i.e. without attributing it to the Imams).

سؤال:هل إن سند دعاء الندبة معتبر؟وإذا كان كذلك فالى أي إمام ينسب مع ذكر المصادر إن سمحتم؟


Question: Is the sanad of Dua Nudba reliable? If so, then could you please let us know to Imam (as) is it attributable, along with the sources?

الجواب:دعاء الندبة أورده السيد علي ابن طاووس في كتابه مصباح الزائر قال: ذكر بعض أصحابنا قال قال محمد بن علي بن أبي قرة: نقلت من كتاب محمد بن الحسين بن سفيان البزوفري رضي الله عنه دعاء الندبة.
وهذا سند مشكل غير نقي إذ يلاحظ عليه -:
أولاً: - إن الفاصل الزمني بين السيد إبن طاووس ومحمد بن علي بن أبي قرة فاصل كبير، فان السيد ابن طاووس توفي سنة 664هـ، بينما محمد بن علي بن أبي قرة هو من مشايخ النجاشي المتوفى سنة 450هـ، وعليه لابد أن تكون هناك أكثر من واسطة وهي مجهولة.
ثانياً: - إن سند محمد بن الحسين بن سفيان البزوفري إلى الدعاء غير مذكور فهوَ سند مجهول أيضاً. ومن هنا لا يصح ما ذكره المجلسي في زاد المعاد من أن دعاء الندبة مروي بسند معتبر عن الإمام الصادق عليه السلام ، إذ لم يذكر لهذا الدعاء سند متصل معتبر.هذا وقد أورد الشيخ محمد بن جعفر بن المشهدي في مزاره الكبير دعاء الندبة وذكر في سنده نحو ما ذكره السيد ابن طاووس والإشكال هو الإشكال. هذا مضافاً إلى أن هذا الدعاء لم يذكر في كتب الأدعية المتقدمة على ابن طاووس كمصباح المتهجد للشيخ الطوسي وهذا ما يضع علامة استفهام، لأن هذا الدعاء اعتبر من أعمال يوم الجمعة ويوم الفطر ويوم الأضحى ويوم الغدير ومضامينه مهمة في زمان الغيبة حسب ثقافة الشيعة الإمامية فان كان له سند معتبر واضح، أو كان دعاء معروفاً فما هو الوجه في إهماله في كتب الدعاء المعتبرة، بل إن السيد إبن طاووس نفسه لم يذكره في سائر كتبه المعدة لبيان الأعمال والأدعية


Answer: Syed Ali b. Tawus recorded Dua Nudba in his book 'Misbahuz Zair'. He wrote: "Some of our companions mentioned: Muhammad b. Ali b. abi Qurah said: I quoted from Muhammad b.al Hussain b. Sufyan al Buzofri (ra) Dua Nudba." Now this sanad is problematic and unsound, as it contains the following issues:

1. There is a large time lapse between Syed Ibn Tawus and Muhammad b. Ali b. abi Qurah, for Syed Ibn Tawus passed away in 664 AH, while Muhammad b. Ali b. abi Qurah is from the teachers of Shaikh al Najashi who passed away in 450 AH. Therefore, there must have been multiple intermediary narrators, but they are not known (majhool).

2. The sanad of Muhammad b.al Hussain b. Sufyan al Buzofri (to the Imam) for this dua is not mentioned, therefore this sanad is majhool as well. Therefore, what Allama Majlisi wrote in his book "Zaadul Ma'ad", regarding Dua Nudba having been narrated by a mu'tbar (reliable) sanad from Imam al Sadiq (as) is incorrect, as no complete and reliable sanad has been mentioned for this dua. Further to this, Shaikh Muhammad b. Ja'far b. al Mashhadi also recorded Dua al Nudba in his book 'Mazar', and mentioned the same sanad as that of Syed Ibn Tawus, therefore the same problems remain. Moreover, this dua is not mentioned in any of the books of supplications prior to Syed Ibn Tawus such as Shaikh Tusi's Misbahul Mujtahid. This raises a question mark, as this dua is considered to be among the recommended acts for Friday, Eid al Fitr, Eid al Adha, and Eid al Ghadeer; and its contents are quite important for the period of occultation, as per the Shia Imami culture. So if it had a reliable a sanad, or was well known, then what is the reason for its exclusion from reliable books of supplication. In fact, even Syed Ibn Tawus himself did not mention this dua in his other books centered around recommended acts and supplications (1).

(1) Translator's note: This particular argument is incorrect, as Syed Ibn Tawus also reported it in Iqbalul Amal (Vol 1 Page 495, in the section abut the supplications to be recited after Eid al Fitr prayer). The rest of the arguments are valid.

س: نحن نحضر دعاء الندبة بشكل أسبوعي، لكن سمعنا أن فيه بعض الألفاظ الداخلة بالغلو ... ، وسمعنا أنه غير صحيح مطلقا ، ولايمكن أن يصدر عن معصوم. هل هذا صحيح؟ :


Question: We attend dua Nudba on a weekly basis, but we heard that it has some words which contain ghulu....., and we heard that it is completely wrong, and it is not possible to have been narrated by any Imam (as). Is this correct?

ج: هذا الدعاء غير ثابت سنداً عن المعصومين (ع).


Answer: On the basis of sanad, this dua is not established to be from the Imams (as).

ما مدى صحّة الأدعية الموجودة اليوم؟ وكيف نتعامل معها؟


What is the basis for the authenticity of the supplications recited these days? And how should we treat them?

السؤال: ورد عدد كبير من الأدعية المنسوبة إلى الأئمة عليهم السلام في الإقبال ومفاتيح الجنان وغيرهما من الكتب, فهل هذه الأدعية ثابتة ومعتبرة؟ وهل ثبت التوقيت الخاصّ بها كدعاء كميل لليلة الجمعة والعهد والندبة و.. كما أننا نجد أنّ المستوى في الأدعية متفاوت من حيث الخطاب، فهل يطالب الإنسان العادي المبتلى بالمعاصي مثلاً بكمال الانقطاع إلى الله، كما ورد في المناجاة الشعبانية إذا قرأها. أرجو من سماحتكم التوجيه في كيفية التعامل مع الأدعية، والإجابة على ما سألت، ولكم الشكر الجزيل.


Question: Lots of Duas attributed to the Imas (as) are written in books like 'Iqbal' (by Syed Ibn Tawus) and Mafatihul Jinan (by Shaikh Abbas al Qummi) as wll as other books; so are these supplications sound and reliable? And are any particular times for them established, such as Dua Kumail on Thursday night, Dua Ahad, Dua Nudba etc..Also, we find that the style of these supplications is quite eloquent in terms of speech, so should a normal sinful person use these supplications to fill the gap of separation and get closer to Allah (swt), as has been mentioned in the supplication of Sha'baniyah when it is read. I would like your eminence to please shed light on this issue as to how should we treat these supplications, and to answer what I asked. Many thanks.

الجواب: أولاً: إنّ الكثير ـ وربما أغلب ـ الأدعية الواردة في مصادر الحديث والأدعية ـ عدا الصحيفة السجاديّة التي يوجد جدل حول سندها ـ ضعيفةٌ من حيث السند على مستوى البحث الرجالي والتوثيق التاريخي؛ نظراً لمشاكل متعدّدة ابتليت بها بعض الكتب التي تشكّل مصادر للأدعية، وأهمّ هذه المشاكل أنّ هذه الكتب حذفت الأسانيد والمصادر التي أخذت منها هذه الأدعية ولم تذكرها أساساً، كما هي الحال مع مثل كتاب مصباح المتهجّد للشيخ أبي جعفر الطوسي (460هـ)،


Answer: First of all: Many, in fact perhaps most, of the supplications mentioned in the books of hadith and supplications, except for Sahifa al Sajjadiyah around which there is disagreement regarding the status of its sanad; are da'eef (weak/unreliable) in terms of sanad as per research in the field of Ilmur Rijal and historical reliability. This is due to the multitude of problems present in the books which form the source of these supplications. The most significant of these problems is that these books have omitted the sanads and sources from which these supplications have been quoted, and have not mentioned them at all. For example, this is the case with Shaikh Tusi (460 AH)'s book 'Misbahul Mujtahid' (our oldest extant book of supplications).

ثراه ) ، فإنه لما سئل عن سند دعاء الندبة أجاب إجابة مطولة ، ثم تحدث في نهايتها عنه وعن محمد بن الحسين بن سفيان البزوفري الراوي للدعاء في كتابه ، بما يدل على منهج التأصيل ، حيث أفاد قائلاً : m وعلى كلّ حالٍ هو من الشيوخ الثقات ، وقد روى الشيخ أبو جعفر الطوسي في مشيخة التهذيبين عن شيوخه عنه كثيراً ، وظاهره الاعتماد عليه ، فبعد ثبوت نقل الدعاء عن كتابه يمكن أن يُعتمد عليه في نقله ، وكان هذا المقدار في أمثال الأدعية والمستحبات كافياً ، وقراءته برجاء المطلوبية لا بأس بها


When Ayatullah Burujerdi was asked about Dua Nudba, he gave a long reply. At the end of which he spoke about the dua and Muhammad b.al Hussain b. Sufyan al Buzofri, the narrator of the dua in his book. What displays his inclination towards proving the authenticity of popular supplications, is that he said: "He (i.e al Buzofri, the narrator of the dua) is from the 'shuyukh al thiqat', and Shaikh Tusi narrated from him a lot via his teachers as seen in the 'mashyakhah' of his tahdhibain, and apparently he considered him reliable (2). So after it being proven that the dua is from his book (3), it is possible to rely on his narration. And this level of proof is sufficient for the likes of supplications and recommended acts, and reciting it with the intention of 'rija al matloobiah' (i.e. not attributing the dua to the Imams, but reciting it with the assumption that reciting the dua itself is good, as supplicating in general is a good act, therefore Allah will reward one for it)."

(2) Translator's note: As per Ayatullah Khoei's manhaj though, al Buzofri is majhool (Al Mufid Min Mujam Rijal al Hadith), as he is not mentioned in any of the classical books of rijal (as explained by Shaikh Hasan Al Musawi al Khurasan in his Sharh Mashyakha Vol 1 Page 36).

(3) Translator's note: It is unclear how Ayatullah Burujerdi reached this conclusion that this dua is proven to be from al Buzofri's book. As seen in Ayatullah Moiyad's arguments posted above, this is definitely not proven.

: سيدنا الأستاذ ، سماحة آية الله العظمى ، السيد محمد صادق الحسيني الروحاني ( دامَ ظله الوارف ) ، فإنه لما سئل عن صحة سند دعاء التوسل والزيارة الجامعة وزيارة عاشوراء ، أجابَ عن ذلك بقوله : m سند زيارة عاشوراء والجامعة معتبر لا إشكال فيه ، وأما دعاء التوسل فهو دعاء مشهور ، وضعفُ سنده لا يضر به ، بعد البناء على تمامية قاعدة التسامح في أدلة السنن
ولمّا سُئِلَ عن سند دعاء الندبة أجاب : m الدعاء واردٌ في غير واحدٍ من كتب القدماء المعتمدة ، وعدم وروده بسندٍ معتبر لا يضر به بعد كونه مشمولاً لقاعدة التسامح في أدلة السنن


Ayatullah Sadiq Rohani, when asked about the authenticity of the isnad of dua tawassul, ziyarah al jamia and ziyarah al ashura; replied: As for the isnad of ziyarah al jamia and ashura, so they are definitely reliable (4), as for dua tawassul so it is a well known dua, and the weakness of its sanad does not effect it on the basis of 'al tasamuh fi adillatis sunan (principle of leniency in deducing proofs for recommended acts)'

And when asked about the sanad of dua nudba, he replied that it has been recorded in multiple reliable books of the classical scholars (5), and it lacking a reliable sanad does not effect it on the basis of 'al tasamuh fi adillatis sunan (principle of leniency in deducing proofs for recommended acts)'.

Is Dua Kumail authentic?

 

السؤال: 1 ـ بحسب مباني العلماء وفي نظركم الشخصي ما مدى صحّة دعاء كميل؟
2 ـ هل دعاء كميل ثابت أم لا؟

Question: As per the standards of scholars, as well as in your own opinion, what is the basis of Dua Kumail's authenticity? Is it authentic or not? 

الجواب: دعاء كميل بن زياد النخعي من الأدعية الرائجة الجميلة الرائعة التي يدعو بها الملايين من المسلمين كلّ ليلة جمعة في مختلف أقطار الأرض، وفيه مضامين عالية، ولهذا الدعاء شروح كثيرة وترجمات متعدّدة، نصّ عليها الباحثون، ومنهم الطهراني في (الذريعة 8: 193، و 13: 258 ـ 259) وغيره، لكن أغلبيّتها الساحقة إن لم يكن جميعها ظهر خلال القرون الأربعة الأخيرة فقط، وقبل ذلك لا ذكر لهذا الدعاء على مستوى الشرح والترجمة والتعليق وغير ذلك.

 Answer: Dua Kumail b. Ziyad al Nakh'i is among one of the most popular, beautiful and wonderful supplications; which is recited every Thursday night by millions of Muslims across the globe. Its content is amazing and many scholars have written exegesis/commentaries on it and translated it into different languages, as stated by researchers such as Agha Buzurg Tehrani (author of the most comprehensive bibliographical encyclopedia of Shi'ite books "Al Dhariah") in his "Al Dhariah" (Vol 8 page 193 and Vol 13 page 258 - 259) and others. However, most of if not all of them, appeared only in the last 4 centuries. Before that, there was no sign or trace of this dua in the realm of exegesis/commentaries, translations, annotations etc of scholars.

أمّا على مستوى الإثبات التاريخي، فإنّ هذا الدعاء يرجع إلى مصدرين أساسيين ـ وسائر الكتب ترجع إليهما ـ وهما:
المصدر الأوّل: وهو الأقدم والأهم، عنيت مصباح المتهجّد للشيخ الطوسي (460هـ)، فقد قال الشيخ: (دعاءٌ آخر، وهو دعاء الخضر عليه السلام: روي أنّ كميل بن زياد النخعي رأى أمير المؤمنين عليه السلام ساجداً يدعو بهذا الدعاء في ليلة النصف من شعبان: اللهم إني أسألك برحمتك التي وسعت كلّ شيء، وبقوّتك التي قهرت بها كلّ شيء..) (مصباح المتهجد: 844 ـ 850).

As for attempting to establish its authenticity historically, this Dua originates from 2 primary sources, and all other books (which contain Dua Kumail) quote it from those 2. And those 2 sources are:

Source 1: "Misbahul Mujtahid" by Shaikh Tusi (413 AH), this is the oldest and most important source. Shaikh Tusi reported in Misbah (Page 844 -850): "...Another dua is 'Dual al Khidher': It has been reported that Kumail b. Ziyad al Nakh'i saw Imam Ali prostrating and reciting the following dua on 15 Sha'ban: Ya Allah! I beseech you by your mercy which covers everything, and by your power by which you subjugate everything....."

وفي هذا المصدر ـ كما رأينا ـ لا يُعرف من أين حصل الشيخ الطوسي على هذا الدعاء، وتفصله عن عصر علي وكميل حوالي أربعة قرون، فلا سند ولا مصدر ولا تحديد لطريقة الحصول على هذا الدعاء، والطوسي لم يذكر أيّ طريق له إلى كميل بن زياد لا في كتاب المصباح ولا في مشيخة التهذيب والاستبصار ولا في الفهرست ولا في أيّ موضعٍ آخر من كتبه حتى نطبّق نظريّة التعويض السندي هنا لتصحيح الحديث. وربما يكون الشيخ الطوسي قد أخذ الدعاء من سند أو مصدر غير معتبر حتى عنده، لكنّه نقله في هذا الكتاب؛ لأنّ كتاب مصباح المتهجّد هو كتاب مندوبات وأعمال ومستحبات، وقد يبني الشيخ الطوسي ـ كما هي طريقة المشهور ـ على التسامح في أدلّة السنن، فنقل لنا الدعاء رغم عدم صحّة سنده أو مصدره عنده، وهذا أمرٌ ممكن في مثل هذه الموضوعات، لاسيما مع علّو مضمونه عنده، بل ربما صحّحه بمضمونه كما يصحّحه بعض العلماء اليوم بهذه الطريقة.

As we can see in this source, it is not known how Shaikh Tusi obtained this dua, while the time lapse between that of his era and that of Imam Ali and Kumail b. Ziyad al Nakh'i is of around 4 centuries. There is no sanad (chain of narrators), no original earlier source and no mention of the method by which this dua was obtained. Shaikh Tusi also did not mention any 'tareeq' (list of shuyukh/teachers via whom he could obtain narrations of earlier people) to Kumail, neither in his "Misbah" nor in Tahdhibain or in his Fihrist, neither in any other place in any of his books; which may allow for "ta'widh al sanad" (i.e. reconstruct the sanad, based on turuq mentioned elsewhere) to authenticate the hadith. Probably, Shaikh Tusi obtained this dua from a source or sanad that was unreliable, even according to him, but he still recorded it in his book because the book "Misbahul Mujtahid" is a book about supplications, recommended acts (mustahabaat) etc (i.e. not a fiqh book about halal and haram) and Shaikh Tusi adopted the popular practice of "Al Tasamuh fi adillatis sunan" (i.e. popular fiqh principle of applying leniency in hadith authentication in issues related supplications, mustahab acts etc; and not involving halal or haram) so he reported the dua despite lack of reliability of its sanad or source near him. This is completely plausible in such (recommended/mustahab) issues, especially with the content of the dua being highly eloquent according to him. Probably Shaikh Tusi considered the dua reliable based on its content, like how some scholars these days have authenticated it based on its content.

المصدر الثاني: كتاب إقبال الأعمال للسيد ابن طاووس (664هـ)، حيث قال: (ومن الدعوات في هذه الليلة ما رويناه بإسنادنا إلى جدّي أبي جعفر الطوسي رضي الله عنه قال: روي أنّ كميل بن زياد النخعي رأى أمير المؤمنين عليه السلام ساجداً يدعو بهذا الدعاء في ليلة النصف من شعبان. أقول: ووجدت في روايةٍ أخرى ما هذا لفظها: قال كميل بن زياد: كنت جالساً مع مولاي أمير المؤمنين عليه السلام في مسجد البصرة، ومعه جماعة من أصحابه، فقال بعضهم: ما معنى قول الله عزّ وجلّ: (فيها يفرق كلّ أمر حكيم)؟ قال عليه السلام: ليلة النصف من شعبان، والذي نفس عليّ بيده إنّه ما من عبدٍ إلا وجميع ما يجري عليه من خيرٍ وشرٍّ مقسومٌ له في ليلة النصف من شعبان إلى آخر السنة في مثل تلك الليلة المقبلة، وما من عبدٍ يحييها ويدعو بدعاء الخضر عليه السلام إلا أجيب له. فلمّا انصرف طرقته ليلاً، فقال عليه السلام: ما جاء بك يا كميل؟ قلت: يا أمير المؤمنين، دعاء الخضر، فقال: اجلس يا كميل، إذا حفظت هذا الدعاء فادعُ به كلّ ليلة جمعة أو في الشهر مرّة أو في السنة مرّة أو في عمرك مرّة تُكف وتُنصر وترزق ولن تعدم المغفرة، يا كميل، أوجب لك طول الصحبة لنا أن نجود لك بما سألت، ثم قال: اكتب: اللهم إني أسألك برحمتك التي وسعت كلّ شيء، وبقوّتك التي قهرت بها كلّ شيء، وخضع لها كلّ شيء، وذلّ لها كلّ شيء، وبجبروتك التي غلبت بها كلّ شيء، وبعزّتك التي لا يقوم لها شيء..) (ابن طاووس، إقبال الأعمال 3: 331 ـ 338).

The second source: The book "Iqbalul A'mal" by Syed Ibn Tawus (664 AH), he reported ('Iqbalul aamal' Vol 3 page 331- 338): "Among the supplications for this night are what we have reported by our sanad to our grandfather Shaikh Tusi, who said: 'It has been reported that Kumail b. Ziyad al Nakh'i saw Imam Ali prostrating and reciting the following dua on 15 Sha'ban'. I say: I found in another narration the following wordings: 'Kumail b. Ziyad al Nakhii said: I was sitting with my master Imam Ali in the mosque of Basra, and with him was a group of his companions. Some of them asked him, what is the meaning of the verse "On that night is made distinct every precise matter" (44:4)? Imam replied: The night of 15 Sha'ban, I swear by the one who created me, there is none but every good and bad that is to happen to him that year until the next 15 Sha'ban night is ordained on the night of 15 Sha'ban. And there is none who supplicates via the dua of Khidher but that his supplication is granted. So when people left for the night (I did not leave), so Imam asked: What is wrong Kumail? I replied: Please teach me Dua al Khider. Imam said: Sit down Kumail, if you memorise this dua and supplicate by it every Thursday night, or once in a month, or once a year, or even once in your whole lifetime; it will suffice you and help you and bless you and you will not be without maghfirah. Kumail, due to your long companionship with us, we are obliged to give you what you seek. Imam then continued: Write: Ya Allah! I beseech you by your mercy which covers everything, by your power which subjugates everything, which conquers and humbles everything, by your ruler-ship which conquers everything, by your honour which nothing can withstand........."

ومن الواضح هنا أنّ ابن طاووس ينقل الحديث الذي رأيناه عند الطوسي في المصباح، فليس هناك من جديد، لكنّه يعود ويذكر لنا أنّه رأى روايةً أخرى في هذا الصدد يذكرها لنا ويسوق بعدها الدعاء، دون أن يبيّن لنا أين رأى تلك الرواية الأخرى، فلا يذكر المصدر ولا السند ولا أيّ معلومات حول الموضوع، رغم أنّه تفصله ستة قرون عن عصر الإمام علي وكميل بن زياد.

 It is obvious here the Ibn Tawus is quoting the hadith which we saw reported from Shaikh Tusi in Misbah in the beginning, so there is nothing new there. But Ibn Tawus does mention that he also saw another narration in this regard and mentions it (as seen above) and then proceeds to the dua, but without mentioning where he saw this narration and neither does he mention any source or sanad or any other relevant information on this; despite that the time gap between him and the era of Imam Ali and Kumail is that of 6 centuries.

والجدير بالذكر أنّ المصدرين يذكران أنّ الدعاء هو دعاء الخضر، ولكن لا يُعرف ماذا يراد بهذه الكلمة، فهل التقى الخضر بعلي بن أبي طالب فأخبره به أم كان يدعو به الخضر سابقاً وأعلم الله عليّاً أو محمّداً بذلك فروياه لهذه الأمّة رغم وجود آية قرآنية في هذا الدعاء (أفمن كان مؤمناً كمن كان فاسقاً لا يستوون)؟ ولا أريد أن أدخل في تحليلٍ يتصل بذكر اسم الخضر وما يحمله هذا الاسم من دلالات عميقة في الثقافة الدينية والصوفيّة، بل سأترك هذا الأمر، وأنصح بمراجعة الكتاب الذي ألّفه الباحث الأستاذ عماد الهلالي حول شخصيّة الخضر في التراث الديني (العبد العالم الخضر عليه السلام، دراسة شاملة وموسّعة عن حياة الخضر عليه السلام وتاريخه من خلال القرآن والسنّة والحديث، طبع دار الكاتب العربي، عام 2010م). 

An important point worthy of attention is, that both the sources mention the dua as the dua of Khidher. But it is not clear as to what is meant by that. Did Khidher meet Imam Ali who then taught it to him, or did Khider use to supplicate with it from before and taught it to Ali (as) or Muhammad (pbuh) and they narrated it for this ummah (although this is strange as) even though the dua contains Quranic verse 32:18 (although the Qur'an had not been revealed then.....)? I do not wish to engage in the discussion regarding the various meanings that the name Khider could convey as per cultural and Sufi thoughts, I will skip that discussion, and suggest referring to Professor Imad al Hilali's book about Khider "Al Abd al Alim al Khider".

كما لا أريد أن أدخل أكثر في الرواية التي يقدّمها لنا السيد ابن طاووس في أنّ الآية الكريمة (فيها يفرق كلّ أمر حكيم) قصدت النصف من شعبان، وأنّ هذا المفهوم يعارض التناسب بين الآيات القرآنية بحيث تكون ليلة القدر في شهر رمضان وليس شعبان (وهو موضوع فيه جدل لا نخوض فيه الساعة)، على أنّ هذه الرواية تعارض بعض الروايات التي ذكرت أنّ المراد بهذه الليلة في الآية الكريمة هو ليلة القدر من رمضان لا شعبان، وهذه مشكلة يجب حلّها كي نأخذ بنقل السيد ابن طاووس هنا. أضف إلى ذلك أنّ الإمام عليّاً عليه السلام يعطي هذا الدعاء لكميل لمكان صحبته وعلاقته بهم عليهم السلام، ولا أعرف هل الأدعية يعطيها الأئمّة لمن حولهم أم يعلّمونها لعموم المسلمين في الأرض حيث يجب تبليغ دين الله للأمّة؟! وهل في هذا الدعاء ما يدعو للتقيّة؟! فكأنّ هذا الدعاء خاصّ وله بُعد غير عام حتى يذكره الإمام عليه السلام لكميل بحكم العلاقة القريبة! هذا تساؤل أتركه للتفكير

Similarly, I do not wish to enter into a discussion about the issue in Ibn Tawus's narration, where it says that the verse "On that night is made distinct every precise matter" (44:4) refers to the night of 15th Sha'ban and that this contradicts the Qur'anic verses which say that 'laylatul Qadr' occurs in Ramadan instead of Sha'ban (this is something on which there is disagreement and we shall not discuss it at the moment). Furthermore, this narration conflicts with othernarrations which state that the night mentioned in verse 44:4 is the Laylatul Qadr of Ramadan instead of Sha'ban. It is important to solve this issue, if we are to take this narration of Ibn Tawus. To add to that, Imam Ali gave this dua to Kumail due to his companionship with him, what I do not understand is that are the Imams supposed to teach duas to only those who are very close to them instead of teaching it to all Muslims because after all the tabligh (propagation) of religion to the whole ummah is wajib on them. And is there anything in this dua which would call for taqiyya (due to which Imam taught this dua only to Kumail)? The narration makes it seem as if there is something secretive in this dua such that the Imam taught it only to Kumail due to his close companionship. I will leave this issue as a food for thought.

وهناك أيضاً تساؤل آخر أدعه للتفكير ـ وقد يجاب عنه ـ وهو أنّ رواية ابن طاووس تفيد أنّ كميل بن زياد كتب الدعاء حيث قاله له الإمام عليّ، وهذا يعني أنّ لديه كتاباً وهو دعاء كميل، ومع ذلك لم نجد ذكره إطلاقاً في كتب الفهارس والمصنّفات ولم يذكره الطوسي ولا النجاشي ولا ابن النديم ولا غيرهم في عداد مصنّفي الشيعة رغم ذكرهم بعض من كَتَبَ في القرن الأوّل الهجري، وهذا لعلّه يؤكّد أنّهم لم يروا هذه الرواية التي ينقلها ابن طاووس أو لم يعتدّوا بها في إثبات كون ابن زياد صاحب مصنّف أو أصل.
هذا، 

And there is another question which bears pondering upon, which I shall answer shortly, which is that Ibn Tawus's narration mentions that Kumail wrote down the dua upon Imam Ali's order; which means he authored a booklet i.e. Dua Kumail, but despite that we do not find any mention of it in the Bibliographical books. (The authors of such books such as) Shaikh Tusi, Shaikh Najashi, Ibn al Nadim nor others mentioned it among Shia books despite mentioning some of the Shia books authored in the 1st century AH. This to an extent confirms that they either had not seen this narration or had not considered it authoritative enough to consider Kumail as the author of an "Asl" or "Musannaf".

وليس هناك مصدر يؤكّد لنا خصوصيّة ليلة الجمعة في هذا الدعاء، سوى هذه الرواية (رواية ابن طاووس) غير المسندة، والتي تعاني من بعض المشاكل؛ لهذا رأينا من يشير إلى اعتماد رواية المصباح للطوسي لا رواية الإقبال لابن طاووس، ورواية المصباح تركّز على هذا الدعاء بوصفه دعاءً يدعى به في ليلة النصف من شعبان لا في كلّ ليلة جمعة.

And there also no source which establishes for us a special status for Thursday night with regards to Dua Kumail, except for the sanad-less narration of Ibn Tawus which suffers from the issues mentioned above. Therefore, in our view, the narration in Misbah of Tusi is relatively more reliable with respect to Ibn Tawus's narration, and the narration in Misbah focuses on labeling this dua as one which is supplicated on the night of 15 Sha'ban instead of every Thursday night.

وبناءً عليه فهذا الدعاء لم يثبت بطريقة علميّة صحيحة، فلا يُعلم مصدره ولا سنده، والكتب التي نقلته لنا قليلة جدّاً (كتابان)، ومن ثمّ يصعب تطبيق قاعدة تعاضد الأسانيد أو المصادر فيه، فإسناده إلى النبي وأهل بيته صعب للغاية، إلا على طريقة من يثبت النصوص والأدعية من خلال طبيعة البيان والمضمون الذي يشبه سائر كلمات الإمام علي أو الأئمّة أو من خلال نورانيّة المضمون العالي الذي يحمله، فمن يحصل له وثوق واطمئنان بصدور هذا الدعاء عن الإمام علي عليه السلام من خلال هذه المعطيات ـ كما يظهر من غير واحد من العلماء مثل الشيخ عبدالهادي الفضلي ـ فهو حجّةٌ له وعليه، وإلا فلا اعتبار بهذا الدعاء من حيث تصويب الإسناد للنبي أو أهل بيته عليهم السلام جميعاً،

Based on all this, this dua cannot be considered authentic as per proper academic standard as the (original) source and sanad for it are unknown, and the books which mention it are very few; basically only 2. Therefore, it is not possible to reconstruct its sanad or find an alternative earlier source for it, which makes attribution of this dua to the Prophet (pbuh) or his progeny very difficult. Except for by the method of those who authenticate narrations and supplications by comparing and checking the similarity of the tone and content with other ahadith of Imam Ali and the Imams (as), or by the eloquence of the content, so one who obtains confidence and satisfaction of this dua being narrated by Imam Ali (as) through these methods; as is the case with multiple scholars such as (Late) Ayatullah Dr. Abdul Hadi al Fadli (1), then it is hujjah for him and upon him only. Otherwise,  there is no reliability of this dua in terms of its attribution to the prophet (pbuh) or the ahlulbayt (as).

 وإنّني أنصح نفسي قبل أن نحكم على الدعاء ـ أيّ دعاء ـ ونسبته من خلال طريقة بيانه ورفعة مضمونه أن تكون لدينا ثقافة واسعة في الأدعية والمناجاة التي تركها لنا سائر العلماء المسلمين، بل وغير المسلمين أيضاً، لنجد أنّ بعضها مما تقشعر له الجلود وتلين له القلوب وتهتزّ له الضمائر وتدمع له العين ويخشع معه القلب، فالثقافة الموسوعيّة والمقارنة هنا ضروريّة قبل التسرّع بإصدار أحكام قد تشوبها العاطفة وما اعتدنا عليه في صغرنا أو تربّينا عليه عفويّاً وتشكّلت لدينا فيه قناعات انطباعية وليست علميّة.

And  I remind myself before grading the dua, in fact any dua, and its attribution to the infallibles (as) by the method of judging its content and its eloquence; that we also have a large collection of supplications from rest of the Muslim scholars (from other sects), in fact even from non-Muslims (such as Psalms of the Hebrew Bible, Hindu Vedas scriptures etc etc ). We find that some of those are so touching that they send chills in the body's skin, melt the hearts, shake the consciences, swell up the eyes with tears and frighten the hearts. Therefore, taking this into consideration is necessary before we jump to conclusions based on emotions and what we have grown up with or been brought up on sanctifying, and issuing judgement based on preconceived notions instead of academic investigation.

وأمّا القول بأنّ اهتمام العلماء به شاهد صحّته فقد بيّنا أنّ الاهتمام هذا لم نجده واضحاً سوى منذ أربعة قرون تقريباً فقط، أمّا قبل ذلك فقد ندر أن تجد شرحاً أو تعليقاً أو ذكراً له فليراجع. نعم، يجب أن أشير إلى أنّ بعض جمل هذا الدعاء وأكثر ذلك في مطلعه، ورد في بعض الروايات الأخرى، ومنها رواية نقلها بعض علماء أهل السنّة في مصنفاتهم الحديثية كابن أبي شيبة في المصنّف، ولكنّ هذا لا يثبت نقل الدعاء الطويل، بل يُثبت بضعة أسطر قليلة منه لو تمّت تلك الروايات أيضاً، 

As for the claim that the special treatment given to this dua by scholars proves its authenticity, then we have already explained that such treatment is not clearly found except since around the last 4 centuries only. As for any earlier than that, then it is rare to find any exegesis/commentary, annotations or mention of it which could be referred to. Yes, it is worth mentioning that some sentences of this dua, mostly from its beginning, have been reported in other narrations. Among them is a narration that has been mentioned by some sunni scholars in their hadith collections, for example by Ibn Abi Shayba in his Musannaf. But this does not prove the whole long dua being reported (in the other narrations), only a very small portion of it, if the authenticity of those other narrations could be established that is.(2)

ومن الغريب ما وجدته عند بعضهم من أنّه يريد تصحيح هذا الدعاء برواية ابن أبي شيبة التي هي ضعيفة السند من جهة وتنقل لنا بضعة أسطر فقط من جهة ثانية، وهو يعلم أنّ الوضع في الحديث كثيراً ما يكون بالإدراج، فيؤتى بحديث معتبر ويضاف فيه أو ينقص منه ويضاف مكان الإنقاص، فانتبه جيداً، فهذا لا يصحّح حديثاً، نعم لو تمّ نقل أغلب مقاطع هذا الدعاء في مطاوي روايات أخَر عن علي عليه السلام لاقتربنا من هذا التصحيح جدّاً، وهو أمرٌ غير متوفّر هنا مع الأسف الشديد..

And I find it strange that some try to authenticate dua Kumail by Ibn Abi Shayba's narration, which is da'eef (weak) in the first place and secondly only contains a very small portion of dua Kumail. It is also well known that fabrication in ahadith is often done by insertion, that is, taking an authentic hadith and adding to it or removing a portion from the hadith and replacing it with something else hence making it look authentic (by doing fabrication within an authentic hadith) although this does not make the hadith authentic. Yes, if most parts of dua Kumail had been reported in other narrations from Imam Ali, then the dua could be authenticated through those narrations. But with great regret, this is not the case in this scenario.

وقال عبد الهادي الفضلي في " دروس في أصول فقه الإمامية " ( ص 258 ) : أمثالُ دعاءِ كميلِ فإن سندَهَ غيرُ ناهضٍ بإثبات صحةِ صدورهِ عن المعصومِ ، لكن الفقيه من خلالِ مقارنته أسلوب هذا الدعاء بما يعرفُهُ من خصائص مميزة لأساليب أدعية أهل البيت يحصل له القطع بأنه صادرٌ عنهم ( عليهم السلام )

'Lessons in the principles of Imami jurisprudence' (Page 258): "The sanad of dua Kumail does not prove its attribution to the infallible (as), but the faqih (Islamic Jurist) can attain absolute certainty that this dua is narrated by the infallible (as) by comparing the tone and style of this dua to the distinguishable style of the duas of ahlulbayt (as)."

Ayt Muhammad Hussain aale Kashif al Ghita had stated similar principle for authenticating duas:

(2) Translator's note: Even if those aami narrations are accepted as authentic by the 'aamma, that would still not prove the authenticity of dua Kumail, as aami Ilmur Rijal and hadith gradings are not authoritative for Shias. Shia ahadith can only be authenticated via aami narrations, if the aami narrations are accompanied by strong qarain and/or aathaar from classical Imami literature and scholars. Regardless, since those narrations only contain small portion of Dua Kumail, this is a non-issue.

A major cause of conflicting ahadith in Shaikh Tusi's Tahdhibain

Shaikh Tusi strove to resolve the confusion regarding conflicting ahadith (i.e. those which conflict with Shi'ite consensus) in his book Tahdhibul Ahkam (which he later summarised into a shorter book 'Al Istibsar', both are collectively referred to as Tahdhibain) by gathering most of them (instead of only reporting the ones which he considered permissible to act upon, as had been the methodology of the earlier scholars such as Shaikh Kulaini, Shaikh Sadooq and Shaikh Mufid) and explaining each of the conflicting hadith. This post sheds light onto why those conflicting ahadith came into existence in the first place.


جاء في أخيار معرفة الرجال، المعروف برجال الكشي، للشيخ الطوسي (جلد ٢ ص ٨٥٥) عن علي بن محمد القتيبي، قال، قال أبو محمد الفضل بن شاذان سأل أبي رضي الله عنه، محمد بن أبي عمير، فقال له: إنك قد لقيت مشايخ العامة فكيف لم تسمع منهم؟ فقال: (قد سمعت منهم، غير أني رأيت كثيرا من أصحابنا قد سمعوا علم العامة وعلم الخاصة، فاختلط عليهم حتى كانوا يروون حديث العامة عن الخاصة وحديث الخاصة عن العامة، فكرهت أن يختلط علي، فتركت ذلك وأقبلت على هذا

It is reported in Rijal al Kashi (Vol 2 Page 855) from Ali b. Muhammad al Qutaibi, who said: Muhammad al Fadal b. Shadhan said: My father (ra) asked Muhammad b. abi Umair:

"You have met non-Shia hadith scholars, then how come you did not record ahadith from them?" Ibn abi Umair replied: "I used to listen to their ahadith, but then I saw that many of our peers would gather knowledge from non-Shias as well as Shias both, which resulted in mix-ups to the extent that they would mistakenly narrate hadith of non-Shias while claiming it to be from the Imams and narrate hadith of the Imams while claiming it to be from non-Shias. I did not want this to happen to me, so I stopped that (listening to non-Shia ahadith) and adopted this approach (of only recording ahadith from the Imams)."

Al-Wilayah al-Tashri'eyyah

In a previous post, the issue of "Wilayah al Takwiniyyah" (Tafwidh) was discussed. This post shall now discuss the other type of wilayah (authority), that is "Wilayah al Tashri'eyyah" i.e. the legislative authority.

 -   حدثنا أبي و محمد بن الحسن بن أحمد بن الوليد رضي الله عنه قالا حدثنا سعد بن عبد الله قال حدثني محمد بن عبد الله المسمعي قال حدثني أحمد بن الحسن الميثمي أنه سئل الرضا (ع) يوما و قد اجتمع عنده قوم من أصحابه و قد كانوا يتنازعون في الحديثين المختلفين عن رسول الله (ص) في الشي‏ء الواحد فقال (ع) إن الله عز و جل حرم حراما و أحل حلالا و فرض فرائض فما جاء في تحليل ما حرم الله أو تحريم ما أحل الله أو دفع فريضة في كتاب الله رسمها بين قائم بلا ناسخ نسخ ذلك فذلك مما لا يسع الأخذ به لأن رسول الله (ص) لم يكن ليحرم ما أحل الله و لا ليحلل ما حرم الله و لا ليغير فرائض الله و أحكامه كان في ذلك كله متبعا مسلما مؤديا عن الله و ذلك قول الله عز و جل إِنْ أَتَّبِعُ إِلَّا ما يُوحى إِلَيَّ فكان (ع) متبعا لله مؤديا عن الله ما أمره به من تبليغ الرسالة قلت فإنه يرد عنكم الحديث في الشي‏ء عن رسول الله (ص) مما ليس في الكتاب و هو في السنة ثم يرد خلافه فقال و كذلك قد نهى رسول الله (ص) عن أشياء نهي حرام فوافق في ذلك نهيه نهي الله تعالى و أمر بأشياء فصار ذلك الأمر واجبا لازما كعدل فرائض الله تعالى و وافق في ذلك أمره أمر الله تعالى فما جاء في النهي عن رسول الله (ص) نهي حرام ثم جاء خلافه
لم يسع استعمال ذلك و كذلك فيما أمر به لأنا لا نرخص فيما لم يرخص فيه رسول الله (ص) و لا نأمر بخلاف ما أمر رسول الله (ص) إلا لعلة خوف ضرورة فأما أن نستحل ما حرم رسول الله (ص) أو نحرم ما استحل رسول الله (ص) فلا يكون ذلك أبدا لأنا تابعون لرسول الله (ص) مسلمون له كما كان رسول الله (ص) تابعا لأمر ربه عز و جل مسلما له و قال عز و جل ما آتاكُمُ الرَّسُولُ فَخُذُوهُ وَ ما نَهاكُمْ عَنْهُ فَانْتَهُوا و إن رسول الله (ص) نهى عن أشياء ليس نهي حرام بل إعافة و كراهة و أمر بأشياء ليس أمر فرض و لا واجب بل أمر فضل و رجحان في الدين ثم رخص في ذلك للمعلول و غير المعلول فما كان عن رسول الله (ص) نهي إعافة أو أمر فضل فذلك الذي يسع استعمال الرخص فيه إذا ورد عليكم عنا فيه الخبران باتفاق يرويه من يرويه في النهي و لا ينكره و كان الخبران صحيحين معروفين باتفاق الناقلة فيهما يجب الأخذ بأحدهما أو بهما جميعا أو بأيهما شئت و أحببت موسع ذلك لك من باب التسليم لرسول الله (ص) و الرد إليه و إلينا و كان تارك ذلك من باب العناد و الإنكار و ترك التسليم لرسول الله (ص) مشركا بالله العظيم فما ورد عليكم من خبرين مختلفين فاعرضوهما على كتاب الله فما كان في كتاب الله موجودا حلالا أو حراما فاتبعوا ما وافق الكتاب و ما لم يكن في الكتاب فاعرضوه على سنن النبي (ص) فما كان في السنة موجودا منهيا عنه نهي حرام أو مأمورا به عن رسول الله (ص) أمر إلزام فاتبعوا ما وافق نهي رسول الله (ص) و أمره و ما كان في السنة نهي إعافة أو كراهة ثم كان الخبر الآخر خلافه فذلك رخصة فيما عافه رسول الله (ص) و كرهه و لم يحرمه فذلك الذي يسع الأخذ بهما جميعا أو بأيهما شئت وسعك الاختيار من باب التسليم و الاتباع و الرد إلى رسول الله (ص) و ما لم تجدوه في شي‏ء من هذه الوجوه فردوا إلينا علمه فنحن أولى بذلك و لا تقولوا فيه بآرائكم و عليكم بالكف و التثبت و الوقوف و أنتم طالبون باحثون حتى يأتيكم البيان من عندنا

Told me my father, and Muhammad b. al Hasan b. Ahmad b. al Walid (ra), who both said: Told us Sa'd b. Abdullah, who said: Told me Muhammad b. Abdullah al Masma'i, who said: Told me Ahmad b. al Hasan al Maitham, who said that one day he asked Imam al Reda (as), while a large group from his companions were gathered around him and were arguing about differing ahadith from the Prophet (pbuh) on a single topic.

So Imam (as) said: "Indeed Allah (swt) made haram the haram things, made halal the halal things and made obligatory the fard (compulsory) things. So what comes up (among ahadith) making halal what Allah has made haram, or making haram what Allah has made halal, or lifting the obligation off what Allah has made fardh in the Qur'an without a "nasikh" (abrogating verse) issued on it to make it "mansookh" (abrogated i.e. no longer required), then it is not allowed to follow that hadith because the Prophet (pbuh) was not authorised to make haram what Allah had made halal, to make halal what Allah had made haram nor to change the faraid (obligatory acts) ordered by Allah and the laws regarding them. In preaching of religion he was completely submissive and obedient to Allah, as testified by Allah (Al Qur'an 46:9) 'I only follow the revelation which is sent to me'. He was completely obedient to Allah with regards to what he was commanded by in propagating the message of the Prophethood (i.e. Islam).

I (i.e. the narrator) said: "So if a hadith is reported from you people (i.e. the Imams) quoting the Prophet on an issue which is not explained in the Qur'an but is recorded in the sunnah, then a hadith comes up against it i.e. the previous hadith (then what should we do?)"

Imam (as) replied: "The Prophet forbid some things, declaring them to be haram, and his prohibition coincided with the prohibition by Allah. And he ordered some things and they became absolutely wajib (obligatory) such as the rules of the obligatory acts ordered by Allah (for example Allah set the obligation for prayers in the Qur'an, and some of the obligatory rules for them were then set out by the Prophet) and his command coincided with the command of Allah. So what has been forbidden by the Prophet, if a hadith is reported going against that, then it is not allowed to adopt it, and like that what the Prophet has ordered we (i.e. the Imams) are not authorised to issue a concession on it in which the Prophet did not make a concession. We do not order against what the Prophet had ordered except due to fear of necessity (such as mitigating circumstantial factors, for example it is reported that Imam Ali decreed zakat on horses also during his reign). As for the possibility of us making halal what was made haram by the Prophet, or making haram what was made halal by the Prophet, so that will never ever happen because we are completely obedient and submitted to the Prophet just like he was fully obedient towards the command of his lord (Allah).

Allah said (al Qur'an 59:7) 'So accept whatever the Messenger gives you, and refrain from whatever he forbids you.'. Indeed the Prophet forbid from many things without making them haram, making them loathed and disliked (makrooh) instead, he also ordered for many duties without making them fard and wajib, instead making them virtuous and superior (to be performed) in the religion (i.e. making them mustahab) and allowed concession in them (the mustahab acts) for those with a valid reason (to not perform it) and for those without a reason as well. So what is prohibited by the Prophet in the sense of being makrooh, or what is ordered by the Prophet in the sense of being mustahab, it is allowed to exercise choice in this matter when two (differing) ahadith are reported from us on that topic, when the same person reports/records both the ahadith and does not discard either of them and considers both of them authentic/reliable and well known.

It is then wajib to follow one of them, or both of them collectively, or whichever one that one wishes to follow. I like to offer you ease on this so that you may obey the Prophet and refer (the ahadith) back to him and us (i.e. submitting to the command of the Prophet without making judgements, and instead conceding that the wisdom behind the apparent contradiction is known to the Prophet and the Imams who inherited his knowledge). And the one who abandons those ahadith out of stubbornness, and rejects them and disobeys the Prophet, he is a mushrik (polytheist).

So what reaches you people in terms of two differing ahadith, present both of them upon the Qur'an. That which is present in the Qur'an with respect to halal or haram, follow the hadith which corresponds to the Qur'an (in that). And that which is not mentioned (explicitly) in the Qur'an, present it to the sunnah of the Prophet. So what is present in the sunnah in terms of haram or wajib, then follow the hadith which corresponds to what has been declared haram or wajib by the Prophet. With regards to what has been declared bad (but not haram) or makrooh by the Prophet, and a hadith is reported against it then it is allowed in that case to exercise choice in the matter which has been declared bad and makrooh by the Prophet but not haram (i.e. it is allowed to personally abstain or not abstain from makrooh things, HOWEVER it is not allowed to declare a makrooh thing to be non makrooh), it is this case in which it is allowed to follow either both the ahadith or whichever one of them that one prefers. This concession has been made for you so as to submit to the Prophet, to obey him and to refer (the ahadith) back to him.

And the ahadith which do not fit into this category (i.e. the Qur'an and sunnah are silent on the topic of their content), then refer the understanding of those ahadith back to us as we are more deserving of it (to analyse ahadith) and do not speak on them with your opinions. It is then obligatory on you to stop, hold steadfast and cease (from further action), and keep investigating until an explanation reaches you from us."

"The ghulat believe that the authority to derive all Islamic laws has been delegated to the Imam. So in their view the Imam  may perform any act that he wills, even forbidding all the obligatory acts or allowing all the forbidden things. The remnants* of these ghulat are still present, such as the AghaKhani Ismailis."

*Translator's note: Among the Imami (Ithna Ash'ari) Shias, some clerics hold a similar belief, in fact taking it even further to extend this authority from the Imams to the ruler of the modern Islamic republic:
"The government can even temporarily prevent performing ḥajj, which is among the important Divine obligations"

Origins of the modern hadith "science"

 And the first one to author a book on Dirayah (analysis of ahadith) among our companions was Shahid al Thani. He summarized Dirayah of Ibn Salah al Shafi'i in his journal, then did its exegesis. That is because he was neither familiar with Iddatul Usul by Shaikh Tusi or Ma'arijul Usul by Muhaqqiq Hilli, so as to be able to discern the difference between the methodology of the classical scholars and the latter scholars, as acknowledged by his son, Shaikh Hasan.

الثاني عشر: أن طريقة المتقدمين مباينة لطريقة العامة، والاصطلاح الجديد موافق لاعتقاد العامة واصطلاحهم، بل هو مأخوذ من كتبهم كما هو ظاهر بالتتبع، وكما يفهم من كلام الشيخ حسن وغيره. وقد أمرنا الأئمة عليهم السلام باجتناب طريقة العامة. وقد تقدم بعض ما يدل على ذلك في القضاء في أحاديث ترجيح الحديثين المختلفين وغيرها

 

The twelfth point is that the method of the classical scholars was contrary to the aama (non shia majority muslim/sunnis)'s method, while the modern terminology of hadith science is in accordance to the belief of the 'aama and their terminologies, rather it is actually derived from their books as  appears through investigation, and as is understood from works of Shaikh Hasan (son of Shahid al Thani) and others. While the Imams(as) have commanded us to avoid the 'aama's method. And there has preceded some material that evidences upon that in the section on judgment of ahadith, involving gauging various ahadith and others.

The second preface: It has been stated by a number of our companions, the contemporary scholars, that the origins of classifying (grading)  the ahadith into the four well known categories (i.e. sahih, hasan, muwathaq and da'eef) is from Allama Hilli or Syed ibn Tawoos. And as for the classical scholars, so the sahih hadith according to them is which appeals to confidence due to the evidence and signs/indicators mentioned by Shaikh Tusi in his book Iddatul Usool. A number of our companions, the muhaditheen (hadith scholars), and a group among the latter mujtahids like Shaikh Majlisi and a collection of those who came after him, they conformed to this method.

وبالجملة، أول من قسم أحاديث أصول أصحابنا - التي كانت مرجعهم في عقائدهم وأعمالهم في زمن الأئمة (عليهم السلام) وكانوا مجمعين على صحة نقلها كلها عنهم (عليهم السلام) - إلى الأقسام الأربعة المشهورة بين المتأخرين العلامة الحلي أو رجل آخر قريب منه، ثم من جاء بعده وافقه كالشهيد الأول والفاضل الشيخ علي والشهيد الثاني وولده صاحب كتابي المعالم والمنتقى والفاضل المتبحر المعاصر بهاء الدين محمد العاملي. والسبب في إحداث ذلك غفلة من أحدثه عن كلام قدمائنا، والسبب في غفلته ألفة ذهنه بما في كتب العامة، والسبب في الألفة أنه لما كانت أرباب الدول من أهل الضلالة وكانت المدرسون في المدارس مظهري طرق الضلال انحصرت طرق الإفادة والاستفادة في كتب العامة، فإذا أراد أحد تحصيل الفضيلة لم يكن له بد من قراءة كتب العامة على مدرسيها

 

And to sum up, the first to classify (grade)he original/principle ahadith of our companions, which were their source of religious beliefs and acts in the era of the Imams (as) and they consented upon their authenticity in being wholly quoted from the Imams (as), into the four categories well known among the latter scholars was Allama Hilli or someone else close to him. Then there are those who followed him afterwards like Shaheed Awwal, Shaikh Ali, Shaheed Thani and his son who has authored the books "al Mu'alim" and "Muntaqul Jiman"; and Shaikh Bahai. And the reason for this change is the ignorance from the works of our classical scholars. And the reason for this ignorance is the intimacy of the mind with what is in the books of the 'aama. And the reason for this intimacy is that when the heads of states are from the people of deviance and the teachers in the schools (religious seminaries) show the deviant's path, confine the way of recourse and refer to books of the 'aama, so when one intends to gain education he is compelled to read the books of the 'aama in the educational institutes.
